| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 12.50(b) and (c), Penal Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) The increase in punishment authorized by this section |
|---|
| 13 | 13 | | applies only to an offense under: |
|---|
| 14 | 14 | | (1) Section 21.11; |
|---|
| 15 | 15 | | (2) Section 22.01; |
|---|
| 16 | 16 | | (3) Section 22.011; |
|---|
| 17 | 17 | | (4) Section 22.04; |
|---|
| 18 | 18 | | (5) Section 22.041; |
|---|
| 19 | 19 | | (6) [(2)] Section 29.02; |
|---|
| 20 | 20 | | (7) [(3)] Section 30.02; [and] |
|---|
| 21 | 21 | | (8) [(4)] Section 31.03; |
|---|
| 22 | 22 | | (9) Section 33.021; |
|---|
| 23 | 23 | | (10) Section 43.25; |
|---|
| 24 | 24 | | (11) Section 43.26; and |
|---|
| 25 | 25 | | (12) Section 43.261. |

| 26 | 26 | | (c) If an offense listed under Subsection (b)(2), (8), or |
|---|
| 27 | 27 | | (12) [(b)(1) or (4)] is punishable as a Class A misdemeanor, the |
|---|
| 28 | 28 | | minimum term of confinement for the offense is increased to 180 |
|---|
| 29 | 29 | | days. If an offense listed under Subsection (b)(3), [or] (4), (7), |
|---|
| 30 | 30 | | (8), or (10) is punishable as a felony of the first degree, the |
|---|
| 31 | 31 | | punishment for that offense may not be increased under this |
|---|
| 32 | 32 | | section. |
|---|
| 33 | 33 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 34 | 34 | | to an offense committed on or after the effective date of this Act. |
|---|
| 35 | 35 | | An offense committed before the effective date of this Act is |
|---|
| 36 | 36 | | governed by the law in effect on the date the offense was committed, |
|---|
| 37 | 37 | | and the former law is continued in effect for that purpose. For |
|---|
| 38 | 38 | | purposes of this section, an offense was committed before the |
|---|
| 39 | 39 | | effective date of this Act if any element of the offense occurred |
|---|
| 40 | 40 | | before that date. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2015. |
