55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment of certain sexual offenses committed in
88 a disaster area or an evacuated area.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 12.50(b) and (c), Penal Code, are
1111 amended to read as follows:
1212 (b) The increase in punishment authorized by this section
1313 applies only to an offense under:
1414 (1) Section 21.11;
1515 (2) Section 22.01;
1616 (3) Section 22.011;
1717 (4) Section 22.04;
1818 (5) Section 22.041;
1919 (6) [(2)] Section 29.02;
2020 (7) [(3)] Section 30.02; [and]
2121 (8) [(4)] Section 31.03;
2222 (9) Section 33.021;
2323 (10) Section 43.25;
2424 (11) Section 43.26; and
2525 (12) Section 43.261.
2626 (c) If an offense listed under Subsection (b)(2), (8), or
2727 (12) [(b)(1) or (4)] is punishable as a Class A misdemeanor, the
2828 minimum term of confinement for the offense is increased to 180
2929 days. If an offense listed under Subsection (b)(3), [or] (4), (7),
3030 (8), or (10) is punishable as a felony of the first degree, the
3131 punishment for that offense may not be increased under this
3232 section.
3333 SECTION 2. The change in law made by this Act applies only
3434 to an offense committed on or after the effective date of this Act.
3535 An offense committed before the effective date of this Act is
3636 governed by the law in effect on the date the offense was committed,
3737 and the former law is continued in effect for that purpose. For
3838 purposes of this section, an offense was committed before the
3939 effective date of this Act if any element of the offense occurred
4040 before that date.
4141 SECTION 3. This Act takes effect September 1, 2015.
