66 AN ACT
77 relating to the powers and duties of a county treasurer.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 602.002, Government Code, is amended to
1010 read as follows:
1111 Sec. 602.002. OATH MADE IN TEXAS. An oath made in this
1212 state may be administered and a certificate of the fact given by:
1313 (1) a judge, retired judge, or clerk of a municipal
1414 court;
1515 (2) a judge, retired judge, senior judge, clerk, or
1616 commissioner of a court of record;
1717 (3) a justice of the peace or a clerk of a justice
1818 court;
1919 (4) an associate judge, magistrate, master, referee,
2020 or criminal law hearing officer;
2121 (5) a notary public;
2222 (6) a member of a board or commission created by a law
2323 of this state, in a matter pertaining to a duty of the board or
2424 commission;
2525 (7) a person employed by the Texas Ethics Commission
2626 who has a duty related to a report required by Title 15, Election
2727 Code, in a matter pertaining to that duty;
2828 (8) a county tax assessor-collector or an employee of
2929 the county tax assessor-collector if the oath relates to a document
3030 that is required or authorized to be filed in the office of the
3131 county tax assessor-collector;
3232 (9) the secretary of state or a former secretary of
3333 state;
3434 (10) an employee of a personal bond office, or an
3535 employee of a county, who is employed to obtain information
3636 required to be obtained under oath if the oath is required or
3737 authorized by Article 17.04 or by Article 26.04(n) or (o), Code of
3838 Criminal Procedure;
3939 (11) the lieutenant governor or a former lieutenant
4040 governor;
4141 (12) the speaker of the house of representatives or a
4242 former speaker of the house of representatives;
4343 (13) the governor or a former governor;
4444 (14) a legislator or retired legislator;
4545 (15) the attorney general or a former attorney
4646 general;
4747 (16) the secretary or clerk of a municipality in a
4848 matter pertaining to the official business of the municipality;
4949 [or]
5050 (17) a peace officer described by Article 2.12, Code
5151 of Criminal Procedure, if:
5252 (A) the oath is administered when the officer is
5353 engaged in the performance of the officer's duties; and
5454 (B) the administration of the oath relates to the
5555 officer's duties; or
5656 (18) a county treasurer.
5757 SECTION 2. Section 83.003(a), Local Government Code, is
5858 amended to read as follows:
5959 (a) A [person first takes office as] county treasurer must
6060 successfully complete an introductory course of instruction in the
6161 performance of the duties of county treasurer:
6262 (1) within one year after the date on which the person
6363 is first elected [takes office] if elected to a full term; or
6464 (2) at the earliest available date after appointment
6565 or election, as applicable, if appointed by the commissioners court
6666 or elected to an unexpired term of county treasurer.
6767 SECTION 3. This Act takes effect September 1, 2015.
