| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 29.003, Education Code, is amended by | |
| 11 | 11 | adding Subsection (c) to read as follows: | |
| 12 | 12 | (c) Notwithstanding Subsection (b), a student who is 21 | |
| 13 | 13 | years of age or older and under 26 years of age is eligible to | |
| 14 | 14 | participate in a school district's special education program if the | |
| 15 | 15 | student is otherwise eligible for the program as provided by this | |
| 16 | 16 | section, and the school district admits students who are 21 years of | |
| 17 | 17 | age or older and under 26 years of age in accordance with Section | |
| 18 | 18 | 25.001(b). | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2015. |
