99 relating to the disposal of pesticides.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 76, Agriculture Code, is
1212 amended by adding Section 76.009 to read as follows:
1313 Sec. 76.009. PESTICIDE DISPOSAL FUND. (a) The pesticide
1414 disposal fund is a fund in the state treasury outside the general
1515 revenue fund. The fund consists of:
1616 (1) money deposited to the credit of the fund under
1717 Section 76.044; and
1818 (2) interest earned on the investment of money in the
1919 fund.
2020 (b) The department shall administer the fund. Money in the
2121 fund may be appropriated only for the purposes of the pesticide
2222 waste and pesticide container collection activities performed
2323 under Section 76.132.
2424 SECTION 2. Section 76.044, Agriculture Code, is amended by
2525 adding Subsection (c) to read as follows:
2626 (c) Of the money received by the department under this
2727 section, the department shall annually deposit to the credit of the
2828 pesticide disposal fund under Section 76.009 an amount to cover the
2929 cost of administering the pesticide waste and pesticide container
3030 collection activities performed under Section 76.132, not to exceed
3131 $400,000.
3232 SECTION 3. Subchapter F, Chapter 76, Agriculture Code, is
3333 amended by adding Section 76.132 to read as follows:
3434 Sec. 76.132. DISPOSAL OF PESTICIDE. The department, in
3535 coordination with the Texas A&M AgriLife Extension Service, shall
3636 organize pesticide waste and pesticide container collection
3737 activities statewide. The department and Texas A&M AgriLife
3838 Extension Service may contract for the services of contractors that
3939 are licensed in the disposal of hazardous waste under Section
4040 401.202, Health and Safety Code, or other contractors to implement
4141 the pesticide waste and pesticide container collection activities
4242 and facilitate the collection of canceled, unregistered, or
4343 otherwise unwanted pesticide products and pesticide containers.
4444 SECTION 4. This Act takes effect September 1, 2015.
