| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 386.205, Health and Safety Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | Sec. 386.205. EVALUATION OF UTILITY COMMISSION AND | |
| 13 | 13 | COMPTROLLER ENERGY EFFICIENCY PROGRAMS. (a) In cooperation with | |
| 14 | 14 | the laboratory, the utility commission shall provide an annual | |
| 15 | 15 | report to the commission that, by county, quantifies the reductions | |
| 16 | 16 | of energy demand, peak loads, and associated emissions of air | |
| 17 | 17 | contaminants achieved from programs implemented by the state energy | |
| 18 | 18 | conservation office and from programs implemented under Section | |
| 19 | 19 | 39.905, Utilities Code. | |
| 20 | 20 | (b) The report must quantify reductions in the emissions of | |
| 21 | 21 | each air contaminant subject to the permitting requirements of | |
| 22 | 22 | Chapter 382. | |
| 23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2015. |
