| 27 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 28 | 8 | | SECTION 1. Chapter 141, Utilities Code, is amended by |
|---|
| 29 | 9 | | adding Section 141.0031 to read as follows: |
|---|
| 30 | 10 | | Sec. 141.0031. DAYS IN BILLING MONTH. (a) A customer's bill |
|---|
| 31 | 11 | | may not include charges for a period of more than: |
|---|
| 32 | 12 | | (1) 32 days for a billing month in which the majority |
|---|
| 33 | 13 | | of days in the billing month occur in December, January, or |
|---|
| 34 | 14 | | February; or |
|---|
| 35 | 15 | | (2) 31 days for a billing month in which the majority |
|---|
| 36 | 16 | | of days in the billing month occur in any other month. |
|---|
| 37 | 17 | | (b) If an extreme condition occurs or continues on or after |
|---|
| 38 | 18 | | the 29th day of a billing month described by Subsection (a)(1), the |
|---|
| 39 | 19 | | billing month may be extended by the number of days the extreme |
|---|
| 40 | 20 | | condition occurs. Extreme conditions include: |
|---|
| 41 | 21 | | (1) iced, flooded, closed, or otherwise impassable |
|---|
| 42 | 22 | | roads in the county in which the customer resides; |
|---|
| 43 | 23 | | (2) a natural disaster, including an earthquake, a |
|---|
| 44 | 24 | | hurricane, a tornado, or winds of more than 60 miles per hour; and |
|---|
| 45 | 25 | | (3) civil disruption, including war, riot, or labor |
|---|
| 46 | 26 | | disruption or stoppage. |
|---|
| 47 | 27 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 48 | 28 | | to a billing month that begins on or after the effective date of |
|---|
| 49 | 29 | | this Act. A billing month that begins before the effective date of |
|---|
| 50 | 30 | | this Act is governed by the law in effect at the time the billing |
|---|
| 51 | 31 | | month began, and the former law is continued in effect for that |
|---|
| 52 | 32 | | purpose. |

| 53 | 33 | | SECTION 3. This Act takes effect September 1, 2015. |
