66 AN ACT
77 relating to persons who solicit customers on behalf of a retail
88 electric provider; adding provisions subject to a criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 17, Utilities Code, is
1111 amended by adding Section 17.0041 to read as follows:
1212 Sec. 17.0041. RETAIL ELECTRIC PROVIDER SALES
1313 REPRESENTATIVES. (a) A retail electric provider may pay a
1414 commission or other form of remuneration to a person for soliciting
1515 potential customers on behalf of the retail electric provider or
1616 for otherwise representing the provider in a sales capacity only if
1717 the retail electric provider finds that the person complied with
1818 the commission's customer protection standards in acting on behalf
1919 of the retail electric provider. A person who receives a payment of
2020 a commission or other form of remuneration from a retail electric
2121 provider for actions taken by the person to solicit potential
2222 customers or to otherwise represent the retail electric provider in
2323 a sales capacity is considered an agent of the retail electric
2424 provider for purposes of enforcing commission rules regarding
2525 customer protection standards.
2626 (b) A retail electric provider shall annually file a report
2727 with the commission that lists the name of each person to whom the
2828 provider has paid a commission or other remuneration for customer
2929 referral or for sales.
3030 (c) The commission shall compile a list of the information
3131 provided under Subsection (b) and make the list available to the
3232 public on the commission's Internet website.
3333 SECTION 2. The change in law made by this Act applies only
3434 to a customer referral or sale for which a customer enters into a
3535 contract with a retail electric provider on or after the effective
3636 date of this Act. A customer referral or sale in which a customer
3737 entered into a contract with a retail electric provider before the
3838 effective date of this Act is governed by the law in effect at that
3939 time, and that law is continued in effect for that purpose.
4040 SECTION 3. This Act takes effect September 1, 2015.
