| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 17, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 17.0041 to read as follows: |
|---|
| 12 | 12 | | Sec. 17.0041. RETAIL ELECTRIC PROVIDER SALES |
|---|
| 13 | 13 | | REPRESENTATIVES. (a) A retail electric provider may pay a |
|---|
| 14 | 14 | | commission or other form of remuneration to a person for soliciting |
|---|
| 15 | 15 | | potential customers on behalf of the retail electric provider or |
|---|
| 16 | 16 | | for otherwise representing the provider in a sales capacity only if |
|---|
| 17 | 17 | | the retail electric provider finds that the person complied with |
|---|
| 18 | 18 | | the commission's customer protection standards in acting on behalf |
|---|
| 19 | 19 | | of the retail electric provider. A person who receives a payment of |
|---|
| 20 | 20 | | a commission or other form of remuneration from a retail electric |
|---|
| 21 | 21 | | provider for actions taken by the person to solicit potential |
|---|
| 22 | 22 | | customers or to otherwise represent the retail electric provider in |
|---|
| 23 | 23 | | a sales capacity is considered an agent of the retail electric |
|---|
| 24 | 24 | | provider for purposes of enforcing commission rules regarding |
|---|
| 25 | 25 | | customer protection standards. |

| 26 | 26 | | (b) A retail electric provider shall annually file a report |
|---|
| 27 | 27 | | with the commission that lists the name of each person to whom the |
|---|
| 28 | 28 | | provider has paid a commission or other remuneration for customer |
|---|
| 29 | 29 | | referral or for sales. |
|---|
| 30 | 30 | | (c) The commission shall compile a list of the information |
|---|
| 31 | 31 | | provided under Subsection (b) and make the list available to the |
|---|
| 32 | 32 | | public on the commission's Internet website. |
|---|
| 33 | 33 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 34 | 34 | | to a customer referral or sale for which a customer enters into a |
|---|
| 35 | 35 | | contract with a retail electric provider on or after the effective |
|---|
| 36 | 36 | | date of this Act. A customer referral or sale in which a customer |
|---|
| 37 | 37 | | entered into a contract with a retail electric provider before the |
|---|
| 38 | 38 | | effective date of this Act is governed by the law in effect at that |
|---|
| 39 | 39 | | time, and that law is continued in effect for that purpose. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2015. |
