55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting a publisher or manufacturer from requiring
88 a school district or open-enrollment charter school to place a
99 minimum order of instructional materials.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 31.151(a), Education Code, is amended to
1212 read as follows:
1313 (a) A publisher or manufacturer of instructional materials:
1414 (1) shall furnish any instructional material the
1515 publisher or manufacturer offers in this state at a price that does
1616 not exceed the lowest price at which the publisher offers that
1717 instructional material for adoption or sale to any state, public
1818 school, or school district in the United States;
1919 (2) shall automatically reduce the price of
2020 instructional material sold for use in a school district or
2121 open-enrollment charter school to the extent that the price is
2222 reduced elsewhere in the United States;
2323 (3) shall provide any instructional material or
2424 ancillary item free of charge in this state to the same extent that
2525 the publisher or manufacturer provides the instructional material
2626 or ancillary item free of charge to any state, public school, or
2727 school district in the United States;
2828 (4) shall guarantee that each copy of instructional
2929 material sold in this state is at least equal in quality to copies
3030 of that instructional material sold elsewhere in the United States
3131 and is free from factual error;
3232 (5) may not become associated or connected with,
3333 directly or indirectly, any combination in restraint of trade in
3434 instructional materials or enter into any understanding or
3535 combination to control prices or restrict competition in the sale
3636 of instructional materials for use in this state;
3737 (6) shall deliver instructional materials to a
3838 school district or open-enrollment charter school;
3939 (7) shall, at the time an order for instructional
4040 materials is acknowledged, provide to school districts or
4141 open-enrollment charter schools an accurate shipping date for
4242 instructional materials that are back-ordered;
4343 (8) shall guarantee delivery of instructional
4444 materials at least 10 business days before the opening day of school
4545 of the year for which the instructional materials are ordered if the
4646 instructional materials are ordered by a date specified in the
4747 sales contract; [and]
4848 (9) shall submit to the State Board of Education an
4949 affidavit certifying any instructional material the publisher or
5050 manufacturer offers in this state to be free of factual errors at
5151 the time the publisher executes the contract required by Section
5252 31.026; and
5353 (10) may not require a school district or
5454 open-enrollment charter school to place a minimum order of
5555 instructional materials.
5656 SECTION 2. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2015.
