7 | 7 | | relating to restrictions on the assessment of the fee charged for |

8 | 8 | | issuance of certain birth records. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 191.0046, Health and Safety Code, is |
---|
11 | 11 | | amended by adding Subsection (e) to read as follows: |
---|
12 | 12 | | (e) The state registrar, a local registrar, or a county |
---|
13 | 13 | | clerk shall issue without fee a certified copy of a birth record to |
---|
14 | 14 | | an applicant who: |
---|
15 | 15 | | (1) appears in person to obtain the record; and |
---|
16 | 16 | | (2) states that the applicant is requesting the record |
---|
17 | 17 | | for the purpose of obtaining an election identification certificate |
---|
18 | 18 | | under Section 521A.001, Transportation Code. |
---|
19 | 19 | | SECTION 2. The change in law made by this Act applies to an |
---|
20 | 20 | | application for a certified copy of a birth record filed on or after |
---|
21 | 21 | | the effective date of this Act. An application for a certified copy |
---|
22 | 22 | | of a birth record filed before the effective date of this Act is |
---|
23 | 23 | | governed by the law in effect on that date, and the former law is |
---|
24 | 24 | | continued in effect for that purpose. |
---|
25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
---|
26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 29 | | Act takes effect September 1, 2015. |
