| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 411.1237, Government Code, is amended to |
|---|
| 15 | 9 | | read as follows: |
|---|
| 16 | 10 | | Sec. 411.1237. ACCESS TO CRIMINAL HISTORY RECORD |
|---|
| 17 | 11 | | INFORMATION: COUNTY FIRE MARSHALS; COUNTY SHERIFFS. (a) On |
|---|
| 18 | 12 | | request of the department chief or chief executive of a fire |
|---|
| 19 | 13 | | department or an emergency medical services provider for an |
|---|
| 20 | 14 | | unincorporated area, a county fire marshal or county sheriff is |
|---|
| 21 | 15 | | entitled to obtain from the department criminal history record |
|---|
| 22 | 16 | | information maintained by the department that relates to: |
|---|
| 23 | 17 | | (1) an applicant for employment or membership with the |
|---|
| 24 | 18 | | requesting fire department or emergency medical services provider; |
|---|
| 25 | 19 | | or |
|---|
| 26 | 20 | | (2) an employee or member of the requesting fire |
|---|
| 27 | 21 | | department or emergency medical services provider. |
|---|
| 28 | 22 | | (b) The county fire marshal or county sheriff may disclose |
|---|
| 29 | 23 | | criminal history record information obtained under Subsection (a) |
|---|
| 30 | 24 | | to the department chief or chief executive of the requesting fire |
|---|
| 31 | 25 | | department or emergency medical services provider, except that the |
|---|
| 32 | 26 | | county fire marshal or county sheriff may disclose criminal history |
|---|
| 33 | 27 | | record information obtained by the department from the Federal |
|---|
| 34 | 28 | | Bureau of Investigation only to governmental entities or as |
|---|
| 35 | 29 | | authorized by federal law, federal executive order, or federal |
|---|
| 36 | 30 | | rule. |

| 37 | 31 | | SECTION 2. This Act takes effect September 1, 2015. |
