137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 411.1237, Government Code, is amended to
159 read as follows:
1610 Sec. 411.1237. ACCESS TO CRIMINAL HISTORY RECORD
1711 INFORMATION: COUNTY FIRE MARSHALS; COUNTY SHERIFFS. (a) On
1812 request of the department chief or chief executive of a fire
1913 department or an emergency medical services provider for an
2014 unincorporated area, a county fire marshal or county sheriff is
2115 entitled to obtain from the department criminal history record
2216 information maintained by the department that relates to:
2317 (1) an applicant for employment or membership with the
2418 requesting fire department or emergency medical services provider;
2519 or
2620 (2) an employee or member of the requesting fire
2721 department or emergency medical services provider.
2822 (b) The county fire marshal or county sheriff may disclose
2923 criminal history record information obtained under Subsection (a)
3024 to the department chief or chief executive of the requesting fire
3125 department or emergency medical services provider, except that the
3226 county fire marshal or county sheriff may disclose criminal history
3327 record information obtained by the department from the Federal
3428 Bureau of Investigation only to governmental entities or as
3529 authorized by federal law, federal executive order, or federal
3630 rule.
3731 SECTION 2. This Act takes effect September 1, 2015.
