99 relating to contingent deferred annuity contracts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1107.002(a), Insurance Code, is amended
1212 to read as follows:
1313 (a) This chapter does not apply to:
1414 (1) a reinsurance contract;
1515 (2) a group annuity contract that is purchased under a
1616 retirement plan or plan of deferred compensation established or
1717 maintained by an employer, including a partnership or sole
1818 proprietorship, by an employee organization, or by both, other than
1919 a plan that provides individual retirement accounts or individual
2020 retirement annuities under Section 408, Internal Revenue Code of
2121 1986, as amended;
2222 (3) a premium deposit fund;
2323 (4) a variable annuity contract;
2424 (5) an investment annuity contract;
2525 (6) an immediate annuity contract;
2626 (7) a deferred annuity contract under which annuity
2727 payments have begun; [or]
2828 (8) a reversionary annuity contract; or
2929 (9) a contingent deferred annuity contract as defined
3030 by Section 1116.003.
3131 SECTION 2. Chapter 1116, Insurance Code, is amended by
3232 adding Section 1116.003 to read as follows:
3333 Sec. 1116.003. RULEMAKING AUTHORITY FOR CONTINGENT
3434 DEFERRED ANNUITY CONTRACTS. (a) In this section, "contingent
3535 deferred annuity contract" means an annuity contract in which a
3636 life insurer makes periodic payments for the annuitant's lifetime
3737 beginning when a designated investment that is not owned or held by
3838 the insurer is depleted to an amount specified by the contract due
3939 to contractually permitted withdrawals, market performance, fees,
4040 or other charges.
4141 (b) The commissioner by rule may adopt reasonable standards
4242 for contingent deferred annuity contracts, including standards
4343 for:
4444 (1) the procedures for department review and approval
4545 of contingent deferred annuity contracts and the criteria the
4646 department will use in approving the contracts;
4747 (2) replacement, suitability, and disclosure
4848 requirements that are consistent with applicable model regulations
4949 developed by the National Association of Insurance Commissioners;
5050 and
5151 (3) advertising of contingent deferred annuity
5252 contracts that are consistent with applicable model regulations
5353 developed by the National Association of Insurance Commissioners.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2015.
