125 relating to the ability of certain county assistance districts to
136 annex roads.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Chapter 387, Local Government Code, is amended
169 by adding Section 387.0031 to read as follows:
1710 Sec. 387.0031. INCLUSION OF ROADS IN CERTAIN DISTRICTS.
1811 (a) This section applies only to a district created by a county with
1912 a population of more than 580,000 that borders a county with a
2013 population of more than four million.
2114 (b) The governing body of a district by order may include in
2215 the district a portion of a road, including associated drainage
2316 areas, that is located in a municipality located in the county that
2417 created the district if the municipality consents to the inclusion.
2518 An election is not required to approve an order described by this
2619 subsection.
2720 (c) The district may use money available to the district to
2821 perform maintenance or improvement on a road and the associated
2922 drainage areas included in the district in accordance with this
3023 section.
3124 SECTION 2. This Act takes effect immediately if it receives
3225 a vote of two-thirds of all the members elected to each house, as
3326 provided by Section 39, Article III, Texas Constitution. If this
3427 Act does not receive the vote necessary for immediate effect, this
3528 Act takes effect September 1, 2015.
