55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to municipal control of certain public retirement systems
88 established for the benefit of municipal employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 810, Government Code, is amended by
1111 adding Section 810.004 to read as follows:
1212 Sec. 810.004. MUNICIPAL CONTROL OF RETIREMENT SYSTEM
1313 PROVISIONS. (a) In this section, "public retirement system" has
1414 the meaning assigned by Section 802.001.
1515 (b) Except as provided by Sections 66 and 67, Article XVI,
1616 Texas Constitution, and notwithstanding any other law, a
1717 municipality that is the sponsoring authority of a public
1818 retirement system that was created under a state statute, but is not
1919 a part of a statewide retirement system, may adopt by ordinance or
2020 resolution, as applicable, provisions that supplement or supersede
2121 the operative provisions of the public retirement system's statute,
2222 including any provision relating to the benefits, participation and
2323 eligibility requirements, funding source or amount, and
2424 administration of the system.
2525 (c) To the extent of a conflict between a statute adopted
2626 before the effective date of the Act enacting this section that
2727 applies to a public retirement system described by Subsection (b)
2828 and a municipal ordinance or resolution adopted by the governing
2929 body of the sponsoring municipality of that retirement system under
3030 this section, the municipal ordinance or resolution prevails.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2015.
