| 9 | 9 | | by the Texas Funeral Service Commission. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 57, Occupations Code, is amended by |
|---|
| 12 | 12 | | adding Section 57.003 to read as follows: |
|---|
| 13 | 13 | | Sec. 57.003. LICENSE SUSPENSION BY STATE AGENCY. (a) For |
|---|
| 14 | 14 | | purposes of this section, "license," as defined by Section 57.001, |
|---|
| 15 | 15 | | includes a driver's license. |
|---|
| 16 | 16 | | (b) A state agency may suspend any license issued by the |
|---|
| 17 | 17 | | agency to a person who fails to pay an administrative penalty |
|---|
| 18 | 18 | | imposed under Chapter 651 when due. |
|---|
| 19 | 19 | | (c) A state agency that receives notice under Section |
|---|
| 20 | 20 | | 651.556(b) shall suspend any license issued by the agency to the |
|---|
| 21 | 21 | | person who is the subject of the notice until the state agency |
|---|
| 22 | 22 | | receives notice from the Texas Funeral Service Commission that the |
|---|
| 23 | 23 | | penalty imposed under Chapter 651 has been paid. |

| 24 | 24 | | SECTION 2. Section 651.551(a), Occupations Code, is amended |
|---|
| 25 | 25 | | to read as follows: |
|---|
| 26 | 26 | | (a) The commission may assess an administrative penalty |
|---|
| 27 | 27 | | against a person, regardless of whether the person holds a license |
|---|
| 28 | 28 | | issued [regulated] under this chapter, if the commission determines |
|---|
| 29 | 29 | | that the person has violated this chapter or a rule adopted under |
|---|
| 30 | 30 | | this chapter. |
|---|
| 31 | 31 | | SECTION 3. Section 651.556, Occupations Code, is amended to |
|---|
| 32 | 32 | | read as follows: |
|---|
| 33 | 33 | | Sec. 651.556. COLLECTION OF PENALTY. (a) On the |
|---|
| 34 | 34 | | commission's request, the attorney general shall bring a civil |
|---|
| 35 | 35 | | action to recover an administrative penalty owed under this |
|---|
| 36 | 36 | | chapter. |
|---|
| 37 | 37 | | (b) The commission may, in addition to making a request |
|---|
| 38 | 38 | | under Subsection (a), establish by rule a procedure to provide |
|---|
| 39 | 39 | | notice to a state agency that a person owes an administrative |
|---|
| 40 | 40 | | penalty under this chapter for purposes of Section 57.003. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect September 1, 2015. |
