66 AN ACT
77 relating to the suspension of occupational and driver's licenses
88 issued to persons who fail to pay an administrative penalty imposed
99 by the Texas Funeral Service Commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 57, Occupations Code, is amended by
1212 adding Section 57.003 to read as follows:
1313 Sec. 57.003. LICENSE SUSPENSION BY STATE AGENCY. (a) For
1414 purposes of this section, "license," as defined by Section 57.001,
1515 includes a driver's license.
1616 (b) A state agency may suspend any license issued by the
1717 agency to a person who fails to pay an administrative penalty
1818 imposed under Chapter 651 when due.
1919 (c) A state agency that receives notice under Section
2020 651.556(b) shall suspend any license issued by the agency to the
2121 person who is the subject of the notice until the state agency
2222 receives notice from the Texas Funeral Service Commission that the
2323 penalty imposed under Chapter 651 has been paid.
2424 SECTION 2. Section 651.551(a), Occupations Code, is amended
2525 to read as follows:
2626 (a) The commission may assess an administrative penalty
2727 against a person, regardless of whether the person holds a license
2828 issued [regulated] under this chapter, if the commission determines
2929 that the person has violated this chapter or a rule adopted under
3030 this chapter.
3131 SECTION 3. Section 651.556, Occupations Code, is amended to
3232 read as follows:
3333 Sec. 651.556. COLLECTION OF PENALTY. (a) On the
3434 commission's request, the attorney general shall bring a civil
3535 action to recover an administrative penalty owed under this
3636 chapter.
3737 (b) The commission may, in addition to making a request
3838 under Subsection (a), establish by rule a procedure to provide
3939 notice to a state agency that a person owes an administrative
4040 penalty under this chapter for purposes of Section 57.003.
4141 SECTION 4. This Act takes effect September 1, 2015.
