A BILL TO BE ENTITLED
AN ACT
relating to disclosure of financial studies and reports associated
with a toll project.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 372, Transportation Code,
is amended by adding Section 372.002 to read as follows:
Sec. 372.002. FINANCIAL STUDIES AND REPORTS SUBJECT TO
DISCLOSURE. (a) Financial studies and reports associated with a
toll project, including financial forecasts and traffic and revenue
reports, are subject to disclosure, inspection, and copying under
Chapter 552, Government Code.
(b) Notwithstanding Sections 223.204(a), 366.403(a), and
370.307(a), this section applies to financial studies and reports
associated with a proposed toll project, regardless of whether a
final contract for the project has been entered into.
SECTION 2. Section 371.052(d), Transportation Code, is
repealed.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
