88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 42.034, Election Code, is amended to
1010 read as follows:
1111 Sec. 42.034. NOTICE TO REGISTRAR; REGISTRAR TO MAKE MAP
1212 AVAILABLE. (a) The commissioners court shall deliver a certified
1313 copy of an order changing a county election precinct boundary to the
1414 voter registrar not later than the seventh day after the date the
1515 order is adopted.
1616 (b) The registrar shall make an electronic version of the
1717 precinct boundary map available on the website of the county. If no
1818 county website is maintained, the registrar shall provide copies of
1919 the precinct boundary map upon written request.
2020 SECTION 2. Sections 42.035(a) and (c), Election Code, are
2121 amended to read as follows:
2222 (a) Not later than [Beginning with] the first week following
2323 the week in which an order changing a county election precinct
2424 boundary is adopted, the commissioners court shall publish notice
25- of the change on the website of the county [in a newspaper in the
26- county once a week for three consecutive weeks].
27- (c) If no county website is maintained [newspaper is
28- published in the county], the commissioners court shall post the
25+ of the change in a newspaper in the county once a week for three
26+ consecutive weeks and on the website of the county.
27+ (c) If no county website is maintained or no newspaper is
28+ published in the county, the commissioners court shall post the
2929 notice at the county courthouse on the bulletin board used for
3030 posting notice of meetings of the commissioners court. The notice
3131 must remain posted continuously for three consecutive weeks.
3232 SECTION 3. The heading to Section 42.036, Election Code, is
3333 amended to read as follows:
3434 Sec. 42.036. ADDITIONAL NOTICE TO CERTAIN COUNTY CHAIRS [IN
3535 POPULOUS COUNTIES].
3636 SECTION 4. Section 42.036(b), Election Code, is amended to
3737 read as follows:
3838 (b) The commissioners court shall deliver written notice of
3939 each proposed change and of each order making a change in a county
4040 election precinct boundary to[:
4141 [(1)] the county chair of each political party that
4242 held a primary election in the county on the most recent general
4343 primary day[;
4444 [(2) the political party's precinct chair of each
4545 affected election precinct; and
4646 [(3) the presiding judge appointed by the
4747 commissioners court for each affected election precinct].
4848 SECTION 5. Sections 42.037(a) and (c), Election Code, are
4949 amended to read as follows:
5050 (a) Not later than the 120th day after the date an order
5151 changing a county election precinct boundary is adopted, the county
5252 clerk shall deliver to the secretary of state a map depicting the
5353 affected precinct's boundary as changed and showing the number of
5454 the precinct. The map may be delivered in an electronic format.
5555 (c) The state librarian shall retain the map for 20 years
5656 after receipt, except that for a map delivered in electronic
5757 format, the state librarian may retain the map for more than 20
5858 years to follow standard retention practices.
5959 SECTION 6. Section 42.036(a), Election Code, is repealed.
6060 SECTION 7. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2015.
