| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 33, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 33.021 to read as follows: |
|---|
| 12 | 12 | | Sec. 33.021. EXCLUSION OF CERTAIN RESOURCES IN DETERMINING |
|---|
| 13 | 13 | | SNAP ELIGIBILITY. In determining the eligibility of an applicant |
|---|
| 14 | 14 | | for or recertifying the eligibility of a recipient of supplemental |
|---|
| 15 | 15 | | nutrition assistance benefits, the department may not consider as |
|---|
| 16 | 16 | | resources: |
|---|
| 17 | 17 | | (1) any liquid resources of the applicant or recipient |
|---|
| 18 | 18 | | or a member of the applicant's or recipient's household; or |
|---|
| 19 | 19 | | (2) any motor vehicle in which the applicant or |
|---|
| 20 | 20 | | recipient or a member of the applicant's or recipient's household |
|---|
| 21 | 21 | | has an ownership interest. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies to an |
|---|
| 23 | 23 | | initial determination or recertification of eligibility of a person |
|---|
| 24 | 24 | | for the supplemental nutrition assistance program under Chapter 33, |
|---|
| 25 | 25 | | Human Resources Code, that is made on or after the effective date of |
|---|
| 26 | 26 | | this Act. |
|---|
| 27 | 27 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 28 | 28 | | a state agency determines that a waiver or authorization from a |
|---|
| 29 | 29 | | federal agency is necessary for implementation of that provision, |
|---|
| 30 | 30 | | the agency affected by the provision shall request the waiver or |
|---|
| 31 | 31 | | authorization and may delay implementing that provision until the |
|---|
| 32 | 32 | | waiver or authorization is granted. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect September 1, 2015. |
