88 AN ACT
99 relating to excepting manufacturers engaged in certain commercial
1010 research and development from certain provisions of the Texas
1111 Controlled Substances Act.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 481.080, Health and Safety Code, is
1414 amended by adding Subsection (d-1) to read as follows:
1515 (d-1) This section does not apply to a chemical manufacturer
1616 engaged in commercial research and development:
1717 (1) whose primary business is the manufacture, use,
1818 storage, or transportation of hazardous, combustible, or explosive
1919 materials;
2020 (2) that operates a secure, restricted location that
2121 contains a physical plant not open to the public, the ingress into
2222 which is constantly monitored by security personnel; and
2323 (3) that holds:
2424 (A) a Voluntary Protection Program Certification
2525 under Section (2)(b)(1), Occupational Safety and Health Act of 1970
2626 (29 U.S.C. Section 651 et seq.); or
2727 (B) a Facility Operations Area authorization
2828 under the Texas Risk Reduction Program (30 T.A.C. Chapter 350).
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2015.
