| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 481.080, Health and Safety Code, is |
|---|
| 14 | 14 | | amended by adding Subsection (d-1) to read as follows: |
|---|
| 15 | 15 | | (d-1) This section does not apply to a chemical manufacturer |
|---|
| 16 | 16 | | engaged in commercial research and development: |
|---|
| 17 | 17 | | (1) whose primary business is the manufacture, use, |
|---|
| 18 | 18 | | storage, or transportation of hazardous, combustible, or explosive |
|---|
| 19 | 19 | | materials; |
|---|
| 20 | 20 | | (2) that operates a secure, restricted location that |
|---|
| 21 | 21 | | contains a physical plant not open to the public, the ingress into |
|---|
| 22 | 22 | | which is constantly monitored by security personnel; and |
|---|
| 23 | 23 | | (3) that holds: |
|---|
| 24 | 24 | | (A) a Voluntary Protection Program Certification |
|---|
| 25 | 25 | | under Section (2)(b)(1), Occupational Safety and Health Act of 1970 |
|---|
| 26 | 26 | | (29 U.S.C. Section 651 et seq.); or |
|---|
| 27 | 27 | | (B) a Facility Operations Area authorization |
|---|
| 28 | 28 | | under the Texas Risk Reduction Program (30 T.A.C. Chapter 350). |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2015. |
