23 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

24 | 8 | | SECTION 1. The heading to Section 1701.157, Occupations |
---|
25 | 9 | | Code, is amended to read as follows: |
---|
26 | 10 | | Sec. 1701.157. MONEY ALLOCATED AND USED FOR TRAINING OR |
---|
27 | 11 | | CONTINUING EDUCATION. |
---|
28 | 12 | | SECTION 2. Section 1701.157(a), Occupations Code, is |
---|
29 | 13 | | amended to read as follows: |
---|
30 | 14 | | (a) Not later than March 1 of each calendar year, the |
---|
31 | 15 | | comptroller shall allocate money deposited during the preceding |
---|
32 | 16 | | calendar year in the general revenue fund to the credit of the law |
---|
33 | 17 | | enforcement officer standards and education fund account for |
---|
34 | 18 | | expenses related to the continuing education of persons licensed |
---|
35 | 19 | | under this chapter as follows: |
---|
36 | 20 | | (1) 20 percent of the money is allocated to all local |
---|
37 | 21 | | law enforcement agencies in this state in equal shares; and |
---|
38 | 22 | | (2) 80 percent of the money is allocated to all local |
---|
39 | 23 | | law enforcement agencies in this state in a share representing a |
---|
40 | 24 | | fixed amount for each position in the agency, as of January 1 of the |
---|
41 | 25 | | preceding calendar year, that is reserved to a person who: |
---|
42 | 26 | | (A) is licensed under this chapter; |
---|
43 | 27 | | (B) works as a peace officer or telecommunicator, |
---|
44 | 28 | | as defined by Section 1701.001, on the average of at least 32 hours |
---|
45 | 29 | | a week; and |
---|
46 | 30 | | (C) is compensated by a political subdivision of |
---|
47 | 31 | | this state at least at the minimum wage and is entitled to all |
---|
48 | 32 | | employee benefits offered to a peace officer or telecommunicator, |
---|
49 | 33 | | as applicable, by the political subdivision. |

50 | 34 | | SECTION 3. This Act takes effect September 1, 2015. |
