55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to persons who are public servants for purposes of the
88 offenses of official oppression and misuse of official information;
99 creating offenses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.03, Penal Code, is amended by adding
1212 Subsection (c-1) to read as follows:
1313 (c-1) For purposes of this section, "public servant"
1414 includes:
1515 (1) an officer, employee, or agent of:
1616 (A) the United States;
1717 (B) a branch, department, or agency of the United
1818 States; or
1919 (C) another person acting under a contract with a
2020 branch, department, or agency of the United States to provide a
2121 security or law enforcement service; or
2222 (2) any other person acting under color of federal
2323 law.
2424 SECTION 2. Section 39.06, Penal Code, is amended by adding
2525 Subsection (d-1) to read as follows:
2626 (d-1) For purposes of this section, "public servant"
2727 includes:
2828 (1) an officer, employee, or agent of:
2929 (A) the United States;
3030 (B) a branch, department, or agency of the United
3131 States; or
3232 (C) another person acting under a contract with a
3333 branch, department, or agency of the United States to provide a
3434 security or law enforcement service; or
3535 (2) any other person acting under color of federal
3636 law.
3737 SECTION 3. This Act shall be construed, as a matter of state
3838 law, to be enforceable up to but no further than the maximum
3939 possible extent consistent with federal constitutional
4040 requirements, even if that construction is not readily apparent,
4141 and such constructions are authorized only to the extent necessary
4242 to save the statute from judicial invalidation.
4343 SECTION 4. The change in law made by this Act applies only
4444 to an offense committed on or after the effective date of this Act.
4545 An offense committed before the effective date of this Act is
4646 governed by the law in effect on the date the offense was committed,
4747 and the former law is continued in effect for that purpose. For
4848 purposes of this section, an offense was committed before the
4949 effective date of this Act if any element of the offense occurred
5050 before that date.
5151 SECTION 5. This Act takes effect September 1, 2015.
