77 relating to transportation of an individual with a mental illness

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter A, Chapter 573, Health
1111 and Safety Code, is amended to read as follows:
1212 SUBCHAPTER A. APPREHENSION BY PEACE OFFICER OR TRANSPORTATION FOR
1313 EMERGENCY DETENTION BY GUARDIAN OR EMERGENCY MEDICAL SERVICES
1414 PERSONNEL
1515 SECTION 2. Subchapter A, Chapter 573, Health and Safety
1616 Code, is amended by adding Sections 573.0035 and 573.005 to read as
1717 follows:
1818 Sec. 573.0035. TRANSPORTATION FOR EMERGENCY DETENTION BY
1919 EMERGENCY MEDICAL SERVICES PERSONNEL. (a) In this section,
2020 "emergency medical care," "emergency medical services personnel,"
2121 and "trauma services" have the meanings assigned by Section
2222 773.003.
2323 (b) Except as provided by Subsection (d), emergency medical
2424 services personnel, without the assistance of a peace officer, may
2525 transport a person directly to an inpatient mental health facility
2626 for a preliminary examination in accordance with Section 573.021 if
2727 the emergency medical services personnel have reason to believe and
2828 do believe that:
2929 (1) the person is mentally ill; and
3030 (2) because of that mental illness, there is a
3131 substantial risk of serious harm to the person or to others unless
3232 the person is immediately restrained.
3333 (c) A substantial risk of serious harm to the person or
3434 others under Subsection (b)(2) may be demonstrated by:
3535 (1) the person's behavior; or
3636 (2) evidence of severe emotional distress and
3737 deterioration in the person's mental condition to the extent that
3838 the person cannot remain at liberty.
3939 (d) Emergency medical services personnel may not transport
4040 a person directly to an inpatient mental health facility if the
4141 person requires emergency medical care or trauma services.
4242 Sec. 573.005. EMERGENCY MEDICAL SERVICES PERSONNEL'S
4343 APPLICATION FOR EMERGENCY DETENTION. (a) In this section,
4444 "emergency medical services personnel" has the meaning assigned by
4545 Section 773.003.
4646 (b) After transporting a person to a facility under Section
4747 573.0035, emergency medical services personnel shall immediately
4848 file an application for detention with the facility.
4949 (c) The application for detention must contain:
5050 (1) a statement that the emergency medical services
5151 personnel have reason to believe and do believe that the person
5252 evidences mental illness;
5353 (2) a statement that the emergency medical services
5454 personnel have reason to believe and do believe that the person
5555 evidences a substantial risk of serious harm to the person or
5656 others;
5757 (3) a specific description of the risk of harm;
5858 (4) a statement that the emergency medical services
5959 personnel have reason to believe and do believe that the risk of
6060 harm is imminent unless the person is immediately restrained;
6161 (5) a statement that the emergency medical services
6262 personnel's beliefs are derived from specific recent behavior,
6363 overt acts, attempts, or threats that were observed by the
6464 emergency medical services personnel; and
6565 (6) a detailed description of the specific behavior,
6666 acts, attempts, or threats.
6767 SECTION 3. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2015.
