55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to abolishing the regulation of guard dog trainers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1702.221(b), Occupations Code, is
1010 amended to read as follows:
1111 (b) An individual must obtain the appropriate endorsement
1212 in accordance with the requirements of this chapter and related
1313 administrative rules if the individual:
1414 (1) is employed as:
1515 (A) an alarm instructor;
1616 (B) an alarm systems installer;
1717 (C) an alarm systems monitor;
1818 (D) an electronic access control device
1919 installer;
2020 (E) a level 3 classroom or firearm instructor;
2121 (F) a locksmith;
2222 (G) [a dog trainer;
2323 [(H)] a manager or branch office manager;
2424 (H) [(I)] a noncommissioned security officer;
2525 (I) [(J)] a level 4 personal protection
2626 instructor;
2727 (J) [(K)] a private investigator;
2828 (K) [(L)] a private security consultant;
2929 (L) [(M)] a security salesperson; or
3030 (M) [(N)] an individual whose duties include
3131 performing another activity for which an endorsement is required
3232 under Subsection (e); or
3333 (2) is an owner who oversees the security-related
3434 aspects of the business, officer, partner, or shareholder of a
3535 license holder.
3636 SECTION 2. Section 1702.283, Occupations Code, is amended
3737 to read as follows:
3838 Sec. 1702.283. CRUELTY TO ANIMALS. A person who has been
3939 convicted of cruelty to animals under Section 42.09 or 42.092,
4040 Penal Code:
4141 (1) is ineligible for a license as a guard dog company
4242 [or for endorsement as a dog trainer]; and
4343 (2) may not be employed to work with dogs as a security
4444 officer by a security services contractor or security department of
4545 a private business that uses dogs to protect individuals or
4646 property or to conduct investigations.
4747 SECTION 3. Section 1702.301(d), Occupations Code, is
4848 amended to read as follows:
4949 (d) Endorsement as a private investigator, manager, branch
5050 office manager, alarm systems installer, security consultant,
5151 security salesperson, or alarm systems monitor [, or dog trainer]
5252 expires on the second anniversary of the date of endorsement.
5353 SECTION 4. Section 1702.225, Occupations Code, is repealed.
5454 SECTION 5. On the effective date of this Act, an endorsement
5555 as a dog trainer issued under Chapter 1702, Occupations Code,
5656 expires.
5757 SECTION 6. (a) The change in law made by this Act does not
5858 affect the validity of a proceeding pending before a court or other
5959 governmental entity on the effective date of this Act.
6060 (b) An offense or other violation of law committed before
6161 the effective date of this Act is governed by the law in effect when
6262 the offense or violation was committed, and the former law is
6363 continued in effect for that purpose. For purposes of this
6464 subsection, an offense or violation was committed before the
6565 effective date of this Act if any element of the offense or
6666 violation occurred before that date.
6767 SECTION 7. This Act takes effect September 1, 2015.
