55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the minimum term of confinement for an offense of
88 illegal dumping in a municipality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 365.012, Health and Safety Code, is
1111 amended by adding Subsection (g-1) to read as follows:
1212 (g-1) The minimum term of confinement for an offense under
1313 this section that is committed inside the boundaries of a
1414 municipality is:
1515 (1) 72 hours for an offense described by Subsection
1616 (d-1);
1717 (2) six days for an offense described by Subsection
1818 (e); or
1919 (3) 12 days for an offense described by Subsection
2020 (f).
2121 SECTION 2. The change in law made by this Act applies only
2222 to an offense committed on or after the effective date of this Act.
2323 An offense committed before the effective date of this Act is
2424 governed by the law in effect when the offense was committed, and
2525 the former law is continued in effect for that purpose. For
2626 purposes of this section, an offense was committed before the
2727 effective date of this Act if any element of the offense was
2828 committed before that date.
2929 SECTION 3. This Act takes effect September 1, 2015.
