77 relating to the operation and administration of and practice in
88 courts in the judicial branch of state government and the
99 composition of certain juvenile boards.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 ARTICLE 1. DISTRICT COURTS AND DISTRICT ATTORNEYS
1212 SECTION 1.01. Section 24.154(b), Government Code, is
1313 amended to read as follows:
1414 (b) The terms of the 52nd District Court begin on the first
1515 Mondays in January and July [June].
1616 SECTION 1.02. (a) Effective January 1, 2017, Subchapter C,
1717 Chapter 24, Government Code, is amended by adding Section 24.584 to
1818 read as follows:
1919 Sec. 24.584. 440TH JUDICIAL DISTRICT (CORYELL COUNTY). The
2020 440th Judicial District is composed of Coryell County.
2121 (b) The 440th Judicial District is created January 1, 2017.
2222 (c) Subchapter D, Chapter 74, Government Code, is amended by
2323 adding Section 74.0971 to read as follows:
2424 Sec. 74.0971. LOCAL ADMINISTRATIVE DISTRICT JUDGE FOR
2525 CORYELL COUNTY. Notwithstanding Section 74.091(b), the local
2626 administrative district judge for Coryell County is selected on the
2727 basis of seniority from the district judges of the 52nd Judicial
2828 District and the 440th Judicial District.
2929 SECTION 1.03. (a) Subchapter C, Chapter 24, Government
3030 Code, is amended by adding Section 24.590 to read as follows:
3131 Sec. 24.590. 446TH JUDICIAL DISTRICT (ECTOR COUNTY). The
3232 446th Judicial District is composed of Ector County.
3333 (b) The 446th Judicial District is created September 1,

3535 SECTION 1.04. (a) Subchapter D, Chapter 24, Government
3636 Code, is amended by adding Section 24.641 to read as follows:
3737 Sec. 24.641. 507TH JUDICIAL DISTRICT (HARRIS COUNTY). The

3939 (b) The 507th Judicial District is created September 1,

4848 (b) The 469th and 470th Judicial Districts are created

7979 (b) Section 43.156(b), Government Code, is repealed.
8080 ARTICLE 2. STATUTORY COUNTY COURTS
8181 SECTION 2.01. (a) Section 25.0331(a), Government Code, is
8282 amended to read as follows:
8383 (a) Cameron County has the following statutory county
8484 courts:
8585 (1) County Court at Law No. 1 of Cameron County;
8686 (2) County Court at Law No. 2 of Cameron County; [and]
8787 (3) County Court at Law No. 3 of Cameron County;
8888 (4) County Court at Law No. 4 of Cameron County; and
8989 (5) County Court at Law No. 5 of Cameron County.
9090 (b) Section 25.0332, Government Code, is amended by adding
9191 Subsection (b) to read as follows:
9292 (b) The County Court at Law No. 4 of Cameron County shall
9393 give preference to probate, guardianship, and mental health
9494 matters.
9595 (c) The County Court at Law No. 4 of Cameron County is
9696 created on January 1, 2016.
9797 (d) The County Court at Law No. 5 of Cameron County is
9898 created on January 1, 2018.
9999 SECTION 2.02. Section 25.2223(a), Government Code, is
100100 amended to read as follows:
101101 (a) A county criminal court in Tarrant County has
102102 jurisdiction over all criminal matters and causes, original and
103103 appellate, prescribed by law for county courts, but does not have
104104 original civil jurisdiction. The County Criminal Courts Nos. 5 and
105105 10 of Tarrant County also have concurrent jurisdiction within the
106106 county of all appeals [from criminal convictions] under the laws of
107107 this state and the municipal ordinances of the municipalities
108108 located in Tarrant County that are appealed from the justice courts
109109 and municipal courts in the county. The County Criminal Courts Nos.
110110 5, 7, 8, 9, and 10 of Tarrant County also have concurrent
111111 jurisdiction with the district court in felony cases to conduct
112112 arraignments, conduct pretrial hearings, and accept guilty pleas.
113113 ARTICLE 3. MAGISTRATES, CERTAIN JUVENILE BOARDS, AND CRIMINAL LAW
114114 HEARING OFFICERS
115115 SECTION 3.01. (a) Section 54.1356(a), Government Code, is
116116 amended to read as follows:
117117 (a) A criminal law hearing officer appointed under this
118118 subchapter has limited concurrent jurisdiction over criminal cases
119119 filed in the district courts, statutory county courts, and justice
120120 courts of the county. The jurisdiction of the criminal law hearing
121121 officer is limited to:
122122 (1) determining probable cause for further detention
123123 of any person detained on a criminal complaint, information, or
124124 indictment filed in the district courts, statutory county courts,
125125 or justice courts of the county;
126126 (2) committing the defendant to jail, discharging the
127127 defendant from custody, or admitting the defendant to bail, as the
128128 law and facts of the case require;
129129 (3) issuing search warrants and arrest warrants as
130130 provided by law for magistrates;
131131 (4) as to criminal cases filed in justice courts,
132132 disposing of cases as provided by law, other than by trial, and
133133 collecting fines and enforcing judgments and orders of the justice
134134 courts in criminal cases;
135135 (5) hearing, considering, and ruling on writs of
136136 habeas corpus filed under Article 17.151, Code of Criminal
137137 Procedure; [and]
138138 (6) on motion of the district attorney:
139139 (A) dismissing a criminal case when the arresting
140140 agency has not timely filed the offense report with the district
141141 attorney; and
142142 (B) reducing the amount of bond on prisoners held
143143 at the county jail whose cases have not been filed in a district
144144 court or a statutory county court; and
145145 (7) presiding over an extradition proceeding under
146146 Article 51.13, Code of Criminal Procedure.
147147 (b) Section 54.1358, Government Code, is amended by adding
148148 Subsections (f) and (g) to read as follows:
149149 (f) In accordance with Article 26.13, Code of Criminal
150150 Procedure, a criminal law hearing officer may accept a plea of
151151 guilty or nolo contendere.
152152 (g) A criminal law hearing officer may determine whether a
153153 defendant is indigent and appoint counsel for an indigent
154154 defendant.
155155 (c) Subchapter BB, Chapter 54, Government Code, is amended
156156 by adding Section 54.1362 to read as follows:
157157 Sec. 54.1362. PROCEEDINGS THAT MAY BE REFERRED. A district
158158 judge or a county court at law judge may refer to a criminal law
159159 hearing officer any criminal case for proceedings involving:
160160 (1) a bond forfeiture;
161161 (2) the arraignment of defendants;
162162 (3) the determination of whether a defendant is
163163 indigent and the appointment of counsel for an indigent defendant;
164164 and
165165 (4) a negotiated plea of guilty or nolo contendere
166166 before the court, in accordance with Article 26.13, Code of
167167 Criminal Procedure.
168168 SECTION 3.02. (a) Chapter 54, Government Code, is amended
169169 by adding Subchapter LL to read as follows:
170170 SUBCHAPTER LL. GALVESTON COUNTY CRIMINAL MAGISTRATES
171171 Sec. 54.2051. APPOINTMENT. (a) The Commissioners Court of
172172 Galveston County may select magistrates to serve the courts of
173173 Galveston County having jurisdiction in criminal matters.
174174 (b) The commissioners court shall establish the minimum
175175 qualifications, salary, benefits, and other compensation of each
176176 magistrate position and shall determine whether the position is
177177 full-time or part-time. The qualifications must require the
178178 magistrate to have served as a justice of the peace or be an
179179 attorney licensed in this state.
180180 (c) A magistrate appointed under this section serves at the
181181 pleasure of the commissioners court.
182182 Sec. 54.2052. JURISDICTION. A magistrate has concurrent
183183 criminal jurisdiction with the judges of the justice of the peace
184184 courts of Galveston County.
185185 Sec. 54.2053. POWERS AND DUTIES. (a) The Commissioners
186186 Court of Galveston County shall establish the powers and duties of a
187187 magistrate appointed under this subchapter. Except as otherwise
188188 provided by the commissioners court, a magistrate has the powers of
189189 a magistrate under the Code of Criminal Procedure and other laws of
190190 this state and may administer an oath for any purpose.
191191 (b) A magistrate shall give preference to performing the
192192 duties of a magistrate under Article 15.17, Code of Criminal
193193 Procedure.
194194 (c) The commissioners court may designate one or more
195195 magistrates to hold regular hearings to:
196196 (1) give admonishments;
197197 (2) set and review bail and conditions of release;
198198 (3) appoint legal counsel; and
199199 (4) determine other routine matters relating to
200200 preindictment or pending cases within those courts' jurisdiction.
201201 (d) In the hearings provided under Subsection (c), a
202202 magistrate shall give preference to the case of an individual held
203203 in county jail.
204204 (e) A magistrate may inquire into a defendant's intended
205205 plea to the charge and set the case for an appropriate hearing
206206 before a judge or master.
207207 Sec. 54.2054. JUDICIAL IMMUNITY. A magistrate has the same
208208 judicial immunity as a district judge.
209209 Sec. 54.2055. WITNESSES. (a) A witness who is sworn and
210210 who appears before a magistrate is subject to the penalties for
211211 perjury and aggravated perjury provided by law.
212212 (b) A referring court may fine or imprison a witness or
213213 other court participant for failure to appear after being summoned,
214214 refusal to answer questions, or other acts of direct contempt
215215 before a magistrate.
216216 (b) Article 2.09, Code of Criminal Procedure, is amended to
217217 read as follows:
218218 Art. 2.09. WHO ARE MAGISTRATES. Each of the following
219219 officers is a magistrate within the meaning of this Code: The
220220 justices of the Supreme Court, the judges of the Court of Criminal
221221 Appeals, the justices of the Courts of Appeals, the judges of the
222222 District Court, the magistrates appointed by the judges of the
223223 district courts of Bexar County, Dallas County, or Tarrant County
224224 that give preference to criminal cases, the criminal law hearing
225225 officers for Harris County appointed under Subchapter L, Chapter
226226 54, Government Code, the criminal law hearing officers for Cameron
227227 County appointed under Subchapter BB, Chapter 54, Government Code,
228228 the magistrates or associate judges appointed by the judges of the
229229 district courts of Lubbock County, Nolan County, or Webb County,
230230 the magistrates appointed by the judges of the criminal district
231231 courts of Dallas County or Tarrant County, the associate judges
232232 appointed by the judges of the district courts and the county courts
233233 at law that give preference to criminal cases in Jefferson County,
234234 the associate judges appointed by the judges of the district courts
235235 and the statutory county courts of Brazos County, Nueces County, or
236236 Williamson County, the magistrates appointed by the judges of the
237237 district courts and statutory county courts that give preference to
238238 criminal cases in Travis County, the criminal magistrates appointed
239239 by the Brazoria County Commissioners Court, the criminal
240240 magistrates appointed by the Burnet County Commissioners Court, the
241241 criminal magistrates appointed by the Galveston County
242242 Commissioners Court, the county judges, the judges of the county
243243 courts at law, judges of the county criminal courts, the judges of
244244 statutory probate courts, the associate judges appointed by the
245245 judges of the statutory probate courts under Chapter 54A,
246246 Government Code, the associate judges appointed by the judge of a
247247 district court under Chapter 54A, Government Code, the magistrates
248248 appointed under Subchapter JJ, Chapter 54, Government Code, as
249249 added by H.B. No. 2132, Acts of the 82nd Legislature, Regular
250250 Session, 2011, the justices of the peace, and the mayors and
251251 recorders and the judges of the municipal courts of incorporated
252252 cities or towns.
253253 (c) This section takes effect immediately if this Act
254254 receives a vote of two-thirds of all the members elected to each
255255 house, as provided by Section 39, Article III, Texas Constitution.
256256 If this Act does not receive the vote necessary for immediate
257257 effect, this section takes effect September 1, 2015.
258258 SECTION 3.03. Section 152.0131(a), Human Resources Code, is
259259 amended to read as follows:
260260 (a) The juvenile board of Atascosa County is composed of the
261261 county judge, [and] the district judges in Atascosa County, and the
262262 judge of the County Court at Law of Atascosa County.
263263 ARTICLE 4. EFFECTIVE DATE
264264 SECTION 4.01. Except as otherwise provided by this Act,
265265 this Act takes effect September 1, 2015.
