66 AN ACT
77 relating to notice requirements for certain meetings or hearings in
88 fire or police departments in certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 143.1014, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 143.1014. NOTICE REQUIREMENT FOR CERTAIN MEETINGS OR
1313 HEARINGS. (a) The department shall provide to a fire fighter or
1414 police officer notice of the time and location of a meeting or
1515 hearing not later than the 48th hour before the hour on which the
1616 meeting or hearing is held if the meeting or hearing is:
1717 (1) related to an internal departmental or other
1818 municipal investigation of the fire fighter or police officer at
1919 which the fire fighter or police officer is required or entitled to
2020 be present, including an interrogation under Section 143.123;
2121 (2) related to a grievance filed by the fire fighter or
2222 police officer under Sections 143.127 through 143.134; or
2323 (3) an opportunity to respond to charges against the
2424 fire fighter or police officer before the department terminates the
2525 fire fighter's or police officer's employment.
2626 (b) The notice required to be provided to a fire fighter
2727 under Subsection (a) must be personally delivered to the fire
2828 fighter or mailed by certified mail, return receipt requested, to
2929 the last home address provided by the fire fighter.
3030 (c) A fire fighter or police officer may waive the notice
3131 prescribed by this section.
3232 SECTION 2. The change in law made by this Act to Section
3333 143.1014, Local Government Code, applies to a notice required to be
3434 provided under that section on or after the effective date of this
3535 Act. A notice required to be provided before the effective date of
3636 this Act is governed by the law in effect immediately before the
3737 effective date of this Act, and the former law is continued in
3838 effect for that purpose.
3939 SECTION 3. This Act takes effect September 1, 2015.
