| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter B, Chapter 322, Health and Safety | |
| 11 | 11 | Code, is amended by adding Section 322.0515 to read as follows: | |
| 12 | 12 | Sec. 322.0515. AUTHORIZATION FOR WHEELCHAIR SAFETY BELT | |
| 13 | 13 | USE. Notwithstanding Section 322.051 and after receipt by a | |
| 14 | 14 | facility of a written authorization signed by a resident or the | |
| 15 | 15 | resident's legal guardian to secure the resident with a wheelchair | |
| 16 | 16 | safety belt, the facility shall secure the resident with a safety | |
| 17 | 17 | belt while the resident is in the resident's wheelchair. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2015. |
