55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to measures to ensure certain adopted students are
88 informed regarding their eligibility for tuition and fee exemptions
99 at certain institutions of higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 51.762, Education Code, is amended by
1212 adding Subsection (j) to read as follows:
1313 (j) The board shall ensure that each application form
1414 adopted under this section solicits from an applicant the
1515 information required for an institution of higher education to
1616 determine whether the applicant is eligible for an exemption from
1717 tuition and fees under Section 54.367 for adopted students formerly
1818 in foster or other residential care.
1919 SECTION 2. Section 54.367, Education Code, is amended by
2020 adding Subsection (c) to read as follows:
2121 (c) The Texas Higher Education Coordinating Board by rule
2222 shall require each institution of higher education to send
2323 information about the tuition and fee exemption under this section
2424 to each applicant who is determined to be eligible for the exemption
2525 by information collected on the applicant's application for
2626 admission.
2727 SECTION 3. The changes in law made by this Act to Sections
2828 51.762 and 54.367, Education Code, apply beginning with
2929 applications for admission to institutions of higher education for
3030 the 2016-2017 academic year.
3131 SECTION 4. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2015.
