| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. The heading to Section 173.004, Election Code, |
|---|
| 9 | 9 | | is amended to read as follows: |
|---|
| 10 | 10 | | Sec. 173.004. STATE COMPENSATION OF COUNTY CHAIR [AND |
|---|
| 11 | 11 | | SECRETARY OF COUNTY EXECUTIVE COMMITTEE]. |
|---|
| 12 | 12 | | SECTION 2. Section 173.004(a), Election Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) The A county chair shall designate one of the following |
|---|
| 15 | 15 | | as the maximum [total] amount payable [paid] with state funds in a |
|---|
| 16 | 16 | | particular primary election year for the [combined] compensation of |
|---|
| 17 | 17 | | a the county chair at the time the statement of estimated primary |
|---|
| 18 | 18 | | expenses is submitted under Section 173.081 by the county chair |
|---|
| 19 | 19 | | [and the secretary, if any, of the county executive committee |
|---|
| 20 | 20 | | presided over by the chair may not be]: |
|---|
| 21 | 21 | | (1) [less than] $300; [or] |
|---|
| 22 | 22 | | (2) if the county executive committee conducts a joint |
|---|
| 23 | 23 | | primary under Section 172.126 or contracts with a county election |
|---|
| 24 | 24 | | officer under Subchapter D, Chapter 31, $300 plus the amount |
|---|
| 25 | 25 | | obtained from multiplying the number of precincts in the county by |
|---|
| 26 | 26 | | $20 [more than the lesser of |
|---|
| 27 | 27 | | [(A) $8,000]; or |
|---|
| 28 | 28 | | (3) an amount equal to [(B)] five percent of the |
|---|
| 29 | 29 | | total expenses incurred by the political party in holding primary |
|---|
| 30 | 30 | | elections in the county that year, exclusive of the [combined] |
|---|
| 31 | 31 | | annual compensation of the county chair and any payments to other |
|---|
| 32 | 32 | | personnel, money spent for rental payments, including polling place |
|---|
| 33 | 33 | | rental, and money spent for expenses related to furniture or |
|---|
| 34 | 34 | | utilities. The resulting compensation under subsection (2) and (3) |
|---|
| 35 | 35 | | shall not exceed: |
|---|
| 36 | 36 | | (A) $3,500 in a county with a population greater |
|---|
| 37 | 37 | | than one million; |
|---|
| 38 | 38 | | (B) $2,000 in a county with a population of one |
|---|
| 39 | 39 | | million or less and greater than 250,000; |
|---|
| 40 | 40 | | (C) $1,000 in a county with a population of |
|---|
| 41 | 41 | | 250,000 or less and greater than 25,000; or |
|---|
| 42 | 42 | | (D) $500 in a county with a population of 25,000 |
|---|
| 43 | 43 | | or less [and secretary]. |

| 44 | 44 | | SECTION 3. Section 173.004(b), Election Code, is repealed. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2015. |
