| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 263, Family Code, is |
|---|
| 13 | 13 | | amended by adding Section 263.0045 to read as follows: |
|---|
| 14 | 14 | | Sec. 263.0045. EDUCATION IN HOME SETTING FOR FOSTER |
|---|
| 15 | 15 | | CHILDREN. On request of a person providing substitute care for a |
|---|
| 16 | 16 | | child who is in the managing conservatorship of the department, the |
|---|
| 17 | 17 | | department shall allow the person to provide the child with an |
|---|
| 18 | 18 | | education in a home setting unless: |
|---|
| 19 | 19 | | (1) the right of the department to allow the education |
|---|
| 20 | 20 | | of the child in a home setting has been specifically limited by |
|---|
| 21 | 21 | | court order; |
|---|
| 22 | 22 | | (2) a court at a hearing conducted under this chapter |
|---|
| 23 | 23 | | finds, on good cause shown through evidence presented by the |
|---|
| 24 | 24 | | department in accordance with the applicable provisions in the |
|---|
| 25 | 25 | | department's child protective services handbook (CPS August 2013), |
|---|
| 26 | 26 | | that education in the home setting is not in the best interest of |
|---|
| 27 | 27 | | the child; or |
|---|
| 28 | 28 | | (3) the department determines that federal law |
|---|
| 29 | 29 | | requires another school setting. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2015. |
