1010 relating to home-school education for foster children.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 263, Family Code, is
1313 amended by adding Section 263.0045 to read as follows:
1414 Sec. 263.0045. EDUCATION IN HOME SETTING FOR FOSTER
1515 CHILDREN. On request of a person providing substitute care for a
1616 child who is in the managing conservatorship of the department, the
1717 department shall allow the person to provide the child with an
1818 education in a home setting unless:
1919 (1) the right of the department to allow the education
2020 of the child in a home setting has been specifically limited by
2121 court order;
2222 (2) a court at a hearing conducted under this chapter
2323 finds, on good cause shown through evidence presented by the
2424 department in accordance with the applicable provisions in the
2525 department's child protective services handbook (CPS August 2013),
2626 that education in the home setting is not in the best interest of
2727 the child; or
2828 (3) the department determines that federal law
2929 requires another school setting.
3030 SECTION 2. This Act takes effect September 1, 2015.
