55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to permissible teachers assigned to a bilingual education
88 program and the permissible uses of the bilingual education
99 allotment provided under the foundation school program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 29.061, Education Code, is amended by
1212 amending Subsection (b) and adding Subsection (b-3) to read as
1313 follows:
1414 (b) Except as provided by Subsection (b-3), a [A] teacher
1515 assigned to a bilingual education program must be appropriately
1616 certified for bilingual education by the board.
1717 (b-3) A school district may assign to a bilingual education
1818 program a teacher certified for English as a second language for a
1919 school year if:
2020 (1) the commissioner has determined that there is a
2121 shortage of teachers certified for bilingual education by the board
2222 for the school year; and
2323 (2) a teacher certified for bilingual education is not
2424 reasonably available to the district.
2525 SECTION 2. Section 42.153(c), Education Code, is amended to
2626 read as follows:
2727 (c) A district's bilingual education or special language
2828 allocation may be used only for program and student evaluation,
2929 instructional materials and equipment, staff development,
3030 supplemental staff expenses, salary [supplements] for teachers,
3131 and other supplies required for quality instruction and smaller
3232 class size.
3333 SECTION 3. This Act applies beginning with the 2015-2016
3434 school year.
3535 SECTION 4. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2015.
