| 7 | 7 | | relating to the management and oversight of state contracts, |

| 8 | 8 | | including contracts for information technology commodity items. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2157.068(a), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) In this section, "commodity items" means commercial |
|---|
| 13 | 13 | | software or[,] hardware[, or technology services, other than |
|---|
| 14 | 14 | | telecommunications services,] that is [are] generally available to |
|---|
| 15 | 15 | | businesses or the public and for which the department determines |
|---|
| 16 | 16 | | that a reasonable demand exists in two or more state agencies. [The |
|---|
| 17 | 17 | | term includes seat management, through which a state agency |
|---|
| 18 | 18 | | transfers its personal computer equipment and service |
|---|
| 19 | 19 | | responsibilities to a private vendor to manage the personal |
|---|
| 20 | 20 | | computing needs for each desktop in the state agency, including all |
|---|
| 21 | 21 | | necessary hardware, software, and support services.] |
|---|
| 22 | 22 | | SECTION 2. Section 2157.068(a), Government Code, as amended |
|---|
| 23 | 23 | | by this Act, applies only in relation to a contract: |
|---|
| 24 | 24 | | (1) for which a state agency first advertises or |
|---|
| 25 | 25 | | otherwise solicits bids, proposals, offers, or qualifications on or |
|---|
| 26 | 26 | | after the effective date of this Act; |
|---|
| 27 | 27 | | (2) that is extended or modified on or after the |
|---|
| 28 | 28 | | effective date of this Act; or |
|---|
| 29 | 29 | | (3) for which a change order is submitted on or after |
|---|
| 30 | 30 | | the effective date of this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2015. |
