9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 31.002, Education Code, is amended by |
---|
11 | 11 | | adding Subdivision (1-b) to read as follows: |
---|
12 | 12 | | (1-b) "Proclamation" means a request for production of |
---|
13 | 13 | | new instructional materials issued by the State Board of Education. |
---|
14 | 14 | | SECTION 2. Section 31.022, Education Code, is amended by |
---|
15 | 15 | | adding Subsection (b-1) and amending Subsection (f) to read as |
---|
16 | 16 | | follows: |
---|
17 | 17 | | (b-1) For any biennium, the board may only issue |
---|
18 | 18 | | proclamations for instructional materials in which the total |
---|
19 | 19 | | projected cost of instructional materials under the proclamations |
---|
20 | 20 | | does not exceed 75 percent of the total amount used to fund the |
---|
21 | 21 | | instructional materials allotment under Section 31.0211 for that |
---|
22 | 22 | | biennium. |
---|
23 | 23 | | (f) The board shall amend any proclamation [request for |
---|
24 | 24 | | production] issued for the purchase of instructional materials to |
---|
25 | 25 | | conform to the instructional materials funding levels provided by |
---|
26 | 26 | | the General Appropriations Act for the year of implementation and |
---|
27 | 27 | | to comply with Subsection (b-1). |
---|
28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
---|
29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
---|
30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
---|
32 | 32 | | Act takes effect September 1, 2015. |
