88 a court, justice, judge, magistrate, or clerk of a judicial court.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 2, Government Code, is amended
1111 by adding Chapter 80 to read as follows:
1212 CHAPTER 80. DELIVERY OF NOTICE AND DOCUMENTS
1313 Sec. 80.001. DELIVERY OF NOTICE OR DOCUMENT. A court,
1414 justice, judge, magistrate, or clerk may send any notice or
1515 document by a method authorized by Section 80.002.
1616 Sec. 80.002. AUTHORIZED DELIVERY OF NOTICE OR DOCUMENT. A
1717 court, justice, judge, magistrate, or clerk may send any notice or
1818 document using mail or electronic mail. This section applies to all
1919 civil and criminal statutes requiring delivery of a notice or
2020 document.
2121 Sec. 80.003. ELECTRONIC MAIL ADDRESS. (a) If electronic
2222 mail is used to send a notice or document and the person who will
2323 receive the notice or document is registered with the electronic
2424 filing system established under Section 72.031, as added by Chapter
2525 1290 (H.B. 2302), Acts of the 83rd Legislature, Regular Session,
2626 2013, the court, justice, judge, magistrate, or clerk sending the
2727 notice or document must use the electronic mail address on file with
2828 the electronic filing system.
2929 (b) If electronic mail is used to send a notice or document
3030 and the person who will receive the notice or document is not
3131 registered with the electronic filing system established under
3232 Section 72.031, as added by Chapter 1290 (H.B. 2302), Acts of the
3333 83rd Legislature, Regular Session, 2013, the court, justice, judge,
3434 magistrate, or clerk must use the electronic mail address provided
3535 by the person.
3636 Sec. 80.004. MAIL. (a) The definition of mail in this
3737 chapter includes:
3838 (1) first-class mail;
3939 (2) first-class United States mail;
4040 (3) ordinary or regular mail; and
4141 (4) international first-class mail.
4242 (b) The definition of mail in this chapter does not include:
4343 (1) any form of mail that requires proof of delivery;
4444 (2) certified mail;
4545 (3) certified mail or a comparable mailing method that
4646 provides proof of delivery;
4747 (4) certified mail, restricted delivery;
4848 (5) certified mail, return receipt requested;
4949 (6) delivery by the United States Postal Service using
5050 a signature confirmation service;
5151 (7) documents delivered by common or contract
5252 carriers, including Federal Express or United Parcel Service;
5353 (8) express mail offered by the United States Postal
5454 Service;
5555 (9) first-class mail, return receipt requested;
5656 (10) freight mail;
5757 (11) interagency mail;
5858 (12) international registered mail, return receipt
5959 requested;
6060 (13) mail, return receipt requested;
6161 (14) personal service or hand delivery;
6262 (15) prepaid registered mail;
6363 (16) registered mail;
6464 (17) registered mail, return receipt requested; and
6565 (18) certified or registered mail, restricted
6666 delivery, return receipt requested.
6767 Sec. 80.005. ELECTRONIC MAIL. (a) Authorized methods of
6868 delivering a notice or document by electronic mail include:
6969 (1) electronic notice sent through the electronic
7070 filing system under Section 72.031, as added by Chapter 1290 (H.B.
7171 2302), Acts of the 83rd Legislature, Regular Session, 2013;
7272 (2) electronic notice;
7373 (3) electronic mail messages;
7474 (4) e-mail; and
7575 (5) secure electronic mail.
7676 (b) Authorized methods of delivering a notice or document by
7777 electronic mail do not include:
7878 (1) facsimiles;
7979 (2) instant messaging;
8080 (3) messages on a social network website, including
8181 Facebook and Twitter;
8282 (4) telegraphs;
8383 (5) telephone messages;
8484 (6) text messages;
8585 (7) videoconferencing;
8686 (8) voice messages; or
8787 (9) webcams.
8888 SECTION 2. This Act takes effect September 1, 2015.
