104 AN ACT
115 relating to the authority of a municipality or county to obtain
126 criminal history record information for certain persons, including
137 employees, independent contractors, and volunteers.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 411.129, Government Code, is amended by
1610 amending Subsection (a) and adding Subsection (a-1) to read as
1711 follows:
1812 (a) Except as provided by Subsection (b), a municipality is
1913 entitled to obtain from the department criminal history record
2014 information maintained by the department that relates to a person
2115 who is:
2216 (1) an applicant for employment by the municipality;
2317 (2) an employee of the municipality;
2418 (3) an applicant for employment by or an employee of a
2519 business or person that contracts with the municipality;
2620 (4) a volunteer with the municipality; or
2721 (5) an applicant for a volunteer position with the
2822 municipality.
2923 (a-1) The [Not later than September 1, 2000, the] department
3024 shall make available through electronic means the information
3125 available to municipalities under this section.
3226 SECTION 2. Section 411.1295(a), Government Code, is amended
3327 to read as follows:
3428 (a) Except as provided by Subsection (b), a county is
3529 entitled to obtain from the department criminal history record
3630 information maintained by the department that relates to a person
3731 who is:
3832 (1) an applicant for employment by the county;
3933 (2) an employee of the county;
4034 (3) an applicant for employment by or an employee of a
4135 business or person that contracts with the county;
4236 (4) a volunteer with the county; or
4337 (5) an applicant for a volunteer position with the
4438 county.
4539 SECTION 3. This Act takes effect September 1, 2015.
