88 AN ACT
99 relating to the prohibition on posting on the Internet information
1010 held by an appraisal district regarding certain residential
1111 property.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 25.027, Tax Code, is amended by amending
1414 Subsection (b) and adding Subsections (c) and (d) to read as
1515 follows:
1616 (b) This section does not apply to:
1717 (1) an aerial photograph that depicts [five or] more
1818 than one separately owned building [buildings];
1919 (2) a street level photograph of only the exterior of a
2020 building; or
2121 (3) a field record or overhead sketch of the property
2222 that depicts only:
2323 (A) the outline of one or more buildings on the
2424 property;
2525 (B) the location of an interior wall in an
2626 outlined building located on the property that separates the main
2727 living area of the building from an ancillary space such as a
2828 garage, patio, or porch;
2929 (C) the general landscape features of the
3030 property, including ponds, pools, and walls; and
3131 (D) the dimensions of or distances between the
3232 buildings and features depicted.
3333 (c) The owner of an improvement to real property described
3434 by Subsection (a) may submit a written request to the chief
3535 appraiser of the appraisal district in which the property is
3636 located requesting that the appraisal district's Internet website
3737 not include information that identifies the person as the owner of
3838 the property. If a request is made under this subsection, the
3939 appraisal district may not post information on, and must as soon as
4040 practicable remove information from, the district's Internet
4141 website that identifies the requestor as the owner of the property
4242 described in the request.
4343 (d) An appraisal district shall post and maintain on the
4444 appraisal district's Internet website a statement informing
4545 property owners of the right to make a request under Subsection (c).
4646 SECTION 2. This Act takes effect September 1, 2015.
