104 AN ACT
115 relating to the limitation on the liability of the nonprofit
126 corporation established by the Texas Public Finance Authority to
137 issue revenue bonds for open-enrollment charter schools to provide
148 educational facilities.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1610 SECTION 1. Section 53.351(b), Education Code, is amended to
1711 read as follows:
1812 (b) The Texas Public Finance Authority shall appoint the
1913 directors of the corporation in consultation with the commissioner
2014 of education and subject to the approval of the
2115 governor. Directors serve without compensation but are entitled
2216 to reimbursement for travel expenses incurred in attending board
2317 meetings. The board shall meet at least once a year.
2418 SECTION 2. Subchapter C, Chapter 53, Education Code, is
2519 amended by adding Section 53.352 to read as follows:
2620 Sec. 53.352. LIMITATION ON LIABILITY OF CORPORATION. A
2721 director, officer, or employee of the nonprofit corporation
2822 established by the Texas Public Finance Authority under Section
2923 53.351 is not personally liable:
3024 (1) for damage, loss, or injury resulting from the
3125 performance of the person's duties under Section 53.351; or
3226 (2) on any commitment or agreement executed on behalf
3327 of the corporation under Section 53.351.
3428 SECTION 3. This Act takes effect immediately if it receives
3529 a vote of two-thirds of all the members elected to each house, as
3630 provided by Section 39, Article III, Texas Constitution. If this
3731 Act does not receive the vote necessary for immediate effect, this
3832 Act takes effect September 1, 2015.
