| 11 | 5 | | relating to the limitation on the liability of the nonprofit |

| 12 | 6 | | corporation established by the Texas Public Finance Authority to |
|---|
| 13 | 7 | | issue revenue bonds for open-enrollment charter schools to provide |
|---|
| 14 | 8 | | educational facilities. |

| 15 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 16 | 10 | | SECTION 1. Section 53.351(b), Education Code, is amended to |
|---|
| 17 | 11 | | read as follows: |
|---|
| 18 | 12 | | (b) The Texas Public Finance Authority shall appoint the |
|---|
| 19 | 13 | | directors of the corporation in consultation with the commissioner |
|---|
| 20 | 14 | | of education and subject to the approval of the |
|---|
| 21 | 15 | | governor. Directors serve without compensation but are entitled |
|---|
| 22 | 16 | | to reimbursement for travel expenses incurred in attending board |
|---|
| 23 | 17 | | meetings. The board shall meet at least once a year. |
|---|
| 24 | 18 | | SECTION 2. Subchapter C, Chapter 53, Education Code, is |
|---|
| 25 | 19 | | amended by adding Section 53.352 to read as follows: |
|---|
| 26 | 20 | | Sec. 53.352. LIMITATION ON LIABILITY OF CORPORATION. A |
|---|
| 27 | 21 | | director, officer, or employee of the nonprofit corporation |
|---|
| 28 | 22 | | established by the Texas Public Finance Authority under Section |
|---|
| 29 | 23 | | 53.351 is not personally liable: |
|---|
| 30 | 24 | | (1) for damage, loss, or injury resulting from the |
|---|
| 31 | 25 | | performance of the person's duties under Section 53.351; or |
|---|
| 32 | 26 | | (2) on any commitment or agreement executed on behalf |
|---|
| 33 | 27 | | of the corporation under Section 53.351. |
|---|
| 34 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 32 | | Act takes effect September 1, 2015. |
