55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eligibility for and allocation of grants from the
88 transportation infrastructure fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 256.101(2), Transportation Code, is
1111 amended to read as follows:
1212 (2) "Transportation infrastructure project" means the
1313 planning for, construction of, reconstruction of, or maintenance of
1414 transportation infrastructure, including roads, bridges, and
1515 culverts[, intended to alleviate degradation caused by the
1616 exploration, development, or production of oil or gas]. The term
1717 includes the lease or rental of equipment used for road
1818 maintenance.
1919 SECTION 2. Section 256.103, Transportation Code, is amended
2020 to read as follows:
2121 Sec. 256.103. GRANT PROGRAM. (a) The department shall
2222 develop policies and procedures to administer a grant program under
2323 this subchapter to make grants to counties for transportation
2424 infrastructure projects [located in areas of the state affected by
2525 increased oil and gas production]. The department may adopt rules
2626 to implement this subchapter.
2727 (b) Grants distributed during a fiscal year must be
2828 allocated among counties as follows:
2929 (1) 20 percent according to weight tolerance permits,
3030 determined by the ratio of weight tolerance permits issued in the
3131 preceding fiscal year for the county that designated a county
3232 energy transportation reinvestment zone to the total number of
3333 weight tolerance permits issued in the state in that fiscal year, as
3434 determined by the Texas Department of Motor Vehicles;
3535 (2) 20 percent according to oil and gas production
3636 taxes, determined by the ratio of oil and gas production taxes
3737 collected by the comptroller in the preceding fiscal year in the
3838 county that designated a county energy transportation reinvestment
3939 zone to the total amount of oil and gas production taxes collected
4040 in the state in that fiscal year, as determined by the comptroller;
4141 (3) 40 [50] percent according to well completions,
4242 determined by the ratio of well completions in the preceding fiscal
4343 year in the county that designated a county energy transportation
4444 reinvestment zone to the total number of well completions in the
4545 state in that fiscal year, as determined by the Railroad Commission
4646 of Texas; [and]
4747 (4) 10 percent according to the volume of oil and gas
4848 waste injected, determined by the ratio of the volume of oil and gas
4949 waste injected in the preceding fiscal year in the county that
5050 designated a county energy transportation reinvestment zone to the
5151 total volume of oil and gas waste injected in the state in that
5252 fiscal year, as determined by the Railroad Commission of Texas; and
5353 (5) 10 percent according to international bridge
5454 crossings, determined by the ratio of international bridge
5555 crossings in the preceding fiscal year in the county to the total
5656 number of international bridge crossings in the state in that
5757 fiscal year.
5858 SECTION 3. Section 256.104(a), Transportation Code, is
5959 amended to read as follows:
6060 (a) In applying for a grant under this subchapter, the
6161 county shall:
6262 (1) provide the road condition report described by
6363 Section 251.018 made by the county for the previous year; and
6464 (2) submit to the department:
6565 (A) if applicable, a copy of the order or
6666 resolution establishing a county energy transportation
6767 reinvestment zone in the county, except that the department may
6868 waive the submission until the time the grant is awarded; and
6969 (B) a plan that:
7070 (i) provides a list of transportation
7171 infrastructure projects to be funded by the grant;
7272 (ii) describes the scope of the
7373 transportation infrastructure project or projects to be funded by
7474 the grant using best practices for prioritizing the projects;
7575 (iii) provides for matching funds as
7676 required by Section 256.105; and
7777 (iv) meets any other requirements imposed
7878 by the department.
7979 SECTION 4. This Act takes effect September 1, 2015.
