| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Subchapter A, Chapter 411, Government Code, is | |
| 10 | 10 | amended by adding Section 411.0094 to read as follows: | |
| 11 | 11 | Sec. 411.0094. AUTOMATIC LICENSE PLATE READER. (a) In this | |
| 12 | 12 | section, "automatic license plate reader" means a system that reads | |
| 13 | 13 | and records license plate numbers taken from digital photographs. | |
| 14 | 14 | (b) Images and any related data produced from an automatic | |
| 15 | 15 | license plate reader may be used by a law enforcement agency only | |
| 16 | 16 | for the following purposes: | |
| 17 | 17 | (1) investigating a criminal offense; or | |
| 18 | 18 | (2) investigating a report of a missing person. | |
| 19 | 19 | (c) All images and data produced from an automatic license | |
| 20 | 20 | plate reader shall be destroyed not later than the seventh day after | |
| 21 | 21 | the date of collection unless the image or data is evidence in a | |
| 22 | 22 | criminal investigation or prosecution. | |
| 23 | 23 | (d) The department shall adopt rules as necessary to | |
| 24 | 24 | implement this section. | |
| 25 | 25 | SECTION 2. This Act takes effect September 1, 2015. |
