| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 38.0028 to read as follows: |
|---|
| 11 | 11 | | Sec. 38.0028. IMMUNIZATION EXEMPTIONS AND VACCINE |
|---|
| 12 | 12 | | PREVENTABLE DISEASE OUTBREAKS; REPORTING. (a) The Department of |
|---|
| 13 | 13 | | State Health Services, using the required annual report submitted |
|---|
| 14 | 14 | | by all schools under Section 38.002(c) and any other relevant |
|---|
| 15 | 15 | | resources, shall create a biennial report on vaccination exemptions |
|---|
| 16 | 16 | | and any outbreaks of vaccine preventable diseases. |
|---|
| 17 | 17 | | (b) The department shall make the report described by |
|---|
| 18 | 18 | | Subsection (a) available on the department's Internet website not |
|---|
| 19 | 19 | | later than December 1 of each even-numbered year. |
|---|
| 20 | 20 | | SECTION 2. The Department of State Health Services shall |
|---|
| 21 | 21 | | post the initial report required by Section 38.0028, Education |
|---|
| 22 | 22 | | Code, as added by this Act, not later than December 1, 2016. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2015. |
