| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 250, Local Government Code, is amended |
|---|
| 13 | 13 | | by adding Section 250.007 to read as follows: |
|---|
| 14 | 14 | | Sec. 250.007. REGULATION OF RENTAL OR LEASING OF HOUSING |
|---|
| 15 | 15 | | ACCOMMODATIONS. (a) A municipality or county may not adopt or |
|---|
| 16 | 16 | | enforce an ordinance or regulation that prohibits an owner, lessee, |
|---|
| 17 | 17 | | sublessee, assignee, managing agent, or other person having the |
|---|
| 18 | 18 | | right to lease, sublease, or rent a housing accommodation from |
|---|
| 19 | 19 | | refusing to lease or rent the housing accommodation to a person |
|---|
| 20 | 20 | | because of the person's lawful source of income to pay rent, |
|---|
| 21 | 21 | | including a federal housing choice voucher. |
|---|
| 22 | 22 | | (b) This section does not affect an ordinance or regulation |
|---|
| 23 | 23 | | adopted before January 1, 2015. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2015. |
