| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 316.093, Government Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 316.093. ADJUSTMENT OF CONSTITUTIONAL ALLOCATIONS TO |
|---|
| 13 | 13 | | FUND, TEXAS RAIL RELOCATION AND IMPROVEMENT FUND, AND STATE HIGHWAY |
|---|
| 14 | 14 | | FUND. |

| 15 | 15 | | SECTION 2. Sections 316.093(b), (c), and (e), Government |
|---|
| 16 | 16 | | Code, are amended to read as follows: |
|---|
| 17 | 17 | | (b) If the sum described by Subsection (a) is less than the |
|---|
| 18 | 18 | | sufficient balance adopted under Section 316.092, the comptroller |
|---|
| 19 | 19 | | shall reduce the allocations [allocation] to the Texas rail |
|---|
| 20 | 20 | | relocation and improvement fund and the state highway fund provided |
|---|
| 21 | 21 | | by Section 49-g(c), Article III, Texas Constitution, and increase |
|---|
| 22 | 22 | | the allocation to the economic stabilization fund, in an [equal] |
|---|
| 23 | 23 | | amount equal to the reductions, until the sufficient balance |
|---|
| 24 | 24 | | adopted under Section 316.092 is achieved. The reductions under |
|---|
| 25 | 25 | | this subsection must be made so that the allocation to a fund is |
|---|
| 26 | 26 | | reduced by the same percentage by which the allocation to the other |
|---|
| 27 | 27 | | fund is reduced. |
|---|
| 28 | 28 | | (c) If under Section 316.092 a sufficient balance has not |
|---|
| 29 | 29 | | been adopted for the comptroller to consider under this section, |
|---|
| 30 | 30 | | the comptroller shall adjust the allocation of amounts to be |
|---|
| 31 | 31 | | transferred to the fund, the Texas rail relocation and improvement |
|---|
| 32 | 32 | | fund, and [to] the state highway fund provided by Section 49-g(c), |
|---|
| 33 | 33 | | Article III, Texas Constitution, so that the total of those amounts |
|---|
| 34 | 34 | | is transferred to the economic stabilization fund, except that the |
|---|
| 35 | 35 | | comptroller shall reduce a transfer made under this subsection as |
|---|
| 36 | 36 | | necessary to prevent the amount in the fund from exceeding the limit |
|---|
| 37 | 37 | | in effect for that biennium under Section 49-g(g) of that article. |

| 38 | 38 | | (e) For the purposes of Section 49-g(c-2), Article III, |
|---|
| 39 | 39 | | Texas Constitution, the comptroller shall adjust the allocation |
|---|
| 40 | 40 | | provided by Section 49-g(c-1) of that article of amounts to be |
|---|
| 41 | 41 | | transferred to the fund, the Texas rail relocation and improvement |
|---|
| 42 | 42 | | fund, and [to] the state highway fund under Section 49-g(c) of that |
|---|
| 43 | 43 | | article in a state fiscal year beginning on or after September 1, |
|---|
| 44 | 44 | | 2025, so that the total of those amounts is transferred to the |
|---|
| 45 | 45 | | economic stabilization fund, except that the comptroller shall |
|---|
| 46 | 46 | | reduce a transfer made under this subsection as necessary to |
|---|
| 47 | 47 | | prevent the amount in the fund from exceeding the limit in effect |
|---|
| 48 | 48 | | for that biennium under Section 49-g(g) of that article. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect on the date on which the |
|---|
| 50 | 50 | | constitutional amendment proposed by the 84th Legislature, Regular |
|---|
| 51 | 51 | | Session, 2015, providing for the transfer of certain general |
|---|
| 52 | 52 | | revenue to the Texas rail relocation and improvement fund takes |
|---|
| 53 | 53 | | effect. If that amendment is not approved by the voters, this Act |
|---|
| 54 | 54 | | has no effect. |
