11	5		relating to authorizing a recreation and wellness facility fee at
12	6		the University of Houston-Clear Lake.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. Subchapter E, Chapter 54, Education Code, is
15	9		amended by adding Section 54.5401 to read as follows:
16	10		Sec. 54.5401. RECREATION AND WELLNESS FACILITY FEE;
17	11		UNIVERSITY OF HOUSTON-CLEAR LAKE. (a) The board of regents of the
18	12		University of Houston System may charge each student enrolled at
19	13		the University of Houston-Clear Lake a recreation and wellness
20	14		facility fee. The fee may be used only for the purpose of financing,
21	15		constructing, operating, maintaining, improving, and equipping a
22	16		recreation and wellness facility and for operating recreation and
23	17		wellness programs at the University of Houston-Clear Lake.
24	18		(b) The recreation and wellness facility fee may not be
25	19		charged unless the charging of the fee is approved by a majority
26	20		vote of the students enrolled at the university participating in a
27	21		general student election held for that purpose.
28	22		(c) The amount of a fee charged under this section may not
29	23		exceed:
30	24		(1) $150 per student for each regular semester;
31	25		(2) $75 per student for each summer session of eight
32	26		weeks or longer; or
33	27		(3) $50 per student for each term of the summer session
34	28		of less than eight weeks.
35	29		(d) Revenue from a fee charged under this section shall be
36	30		deposited to the credit of an account known as the University of
37	31		Houston-Clear Lake Recreation and Wellness Facility Fee Account.
38	32		(e) The board of regents may increase the amount of a fee
39	33		charged under this section, except that the board may not increase
40	34		the amount of the fee to an amount that exceeds by more than 10
41	35		percent the amount of the fee charged during the preceding academic
42	36		year unless the amount of the increase is approved by a majority
43	37		vote of students enrolled at the university participating in a
44	38		general student election held for that purpose.
45	39		(f) The recreation and wellness facility fee is not
46	40		considered in determining the maximum amount of student services
47	41		fees that may be charged under Section 54.503.
48	42		SECTION 2. This Act takes effect immediately if it receives
49	43		a vote of two-thirds of all the members elected to each house, as
50	44		provided by Section 39, Article III, Texas Constitution. If this
51	45		Act does not receive the vote necessary for immediate effect, this
52	46		Act takes effect September 1, 2015.
