104 AN ACT
115 relating to authorizing a recreation and wellness facility fee at
126 the University of Houston-Clear Lake.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Subchapter E, Chapter 54, Education Code, is
159 amended by adding Section 54.5401 to read as follows:
1610 Sec. 54.5401. RECREATION AND WELLNESS FACILITY FEE;
1711 UNIVERSITY OF HOUSTON-CLEAR LAKE. (a) The board of regents of the
1812 University of Houston System may charge each student enrolled at
1913 the University of Houston-Clear Lake a recreation and wellness
2014 facility fee. The fee may be used only for the purpose of financing,
2115 constructing, operating, maintaining, improving, and equipping a
2216 recreation and wellness facility and for operating recreation and
2317 wellness programs at the University of Houston-Clear Lake.
2418 (b) The recreation and wellness facility fee may not be
2519 charged unless the charging of the fee is approved by a majority
2620 vote of the students enrolled at the university participating in a
2721 general student election held for that purpose.
2822 (c) The amount of a fee charged under this section may not
2923 exceed:
3024 (1) $150 per student for each regular semester;
3125 (2) $75 per student for each summer session of eight
3226 weeks or longer; or
3327 (3) $50 per student for each term of the summer session
3428 of less than eight weeks.
3529 (d) Revenue from a fee charged under this section shall be
3630 deposited to the credit of an account known as the University of
3731 Houston-Clear Lake Recreation and Wellness Facility Fee Account.
3832 (e) The board of regents may increase the amount of a fee
3933 charged under this section, except that the board may not increase
4034 the amount of the fee to an amount that exceeds by more than 10
4135 percent the amount of the fee charged during the preceding academic
4236 year unless the amount of the increase is approved by a majority
4337 vote of students enrolled at the university participating in a
4438 general student election held for that purpose.
4539 (f) The recreation and wellness facility fee is not
4640 considered in determining the maximum amount of student services
4741 fees that may be charged under Section 54.503.
4842 SECTION 2. This Act takes effect immediately if it receives
4943 a vote of two-thirds of all the members elected to each house, as
5044 provided by Section 39, Article III, Texas Constitution. If this
5145 Act does not receive the vote necessary for immediate effect, this
5246 Act takes effect September 1, 2015.
