44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to ballot language for a proposition to approve the
77 issuance of bonds by a county.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 52.072(e), Election Code, is amended to
1010 read as follows:
1111 (e) In addition to any other requirement imposed by law for
1212 a proposition, including a provision prescribing the proposition
1313 language, a proposition submitted to the voters for approval of the
1414 issuance of bonds or the imposition, increase, or reduction of a tax
1515 shall specifically state, as applicable:
1616 (1) with respect to a proposition seeking voter
1717 approval of the issuance of bonds:
1818 (A) the total principal amount of the bonds to be
1919 authorized, if approved; [and]
2020 (B) a general description of the purposes for
2121 which the bonds are to be authorized, if approved; and
2222 (C) if the issuer is a county:
2323 (i) the most recent rating, if any, given by
2424 Standard and Poor's or another industry-recognized bond rating
2525 service to bonds issued by the county; and
2626 (ii) a plain-language description of the
2727 applicable bond rating system, if a bond rating is required to be
2828 stated under Subparagraph (i);
2929 (2) with respect to a proposition that only seeks
3030 voter approval of the imposition or increase of a tax, the amount of
3131 or maximum tax rate of the tax or tax increase for which approval is
3232 sought; or
3333 (3) with respect to a proposition that only seeks
3434 voter approval of the reduction of a tax, the amount of tax rate
3535 reduction or the tax rate for which approval is sought.
3636 SECTION 2. The change in law made by this Act applies only
3737 to an election ordered on or after the effective date of this Act.
3838 An election ordered before the effective date of this Act is
3939 governed by the law in effect when the election was ordered.
4040 SECTION 3. This Act takes effect January 1, 2016.
