66 AN ACT
77 relating to the establishment of the contract management division
88 of the Legislative Budget Board.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2262, Government Code, is amended by
1111 adding Subchapter E to read as follows:
1212 SUBCHAPTER E. CONTRACT MANAGEMENT DIVISION
1313 Sec. 2262.201. DEFINITION. In this subchapter, "division"
1414 means the contract management division established by the
1515 Legislative Budget Board under this subchapter.
1616 Sec. 2262.202. ESTABLISHMENT; GENERAL DUTIES. (a) The
1717 Legislative Budget Board shall establish a contract management
1818 division to:
1919 (1) provide recommendations and assistance to state
2020 agency personnel throughout the contract management process; and
2121 (2) review all contracts that have a value of at least
2222 $5 million and identify certain contracts that are experiencing
2323 cost overruns or performance failure or are otherwise demonstrating
2424 poor management.
2525 (b) For contracts identified under Subsection (a)(2), the
2626 division shall:
2727 (1) contact the state agency that executed the
2828 contract to report on the issues identified by the division; and
2929 (2) develop with the state agency a plan to address the
3030 contract issues.
3131 (c) The division shall notify the Legislative Budget Board
3232 as soon as practicable if:
3333 (1) the division is unable to develop a plan under
3434 Subsection (b)(2) with a state agency; or
3535 (2) a state agency fails to implement a plan developed
3636 under Subsection (b)(2).
3737 (d) If, after consultation with the division, the
3838 Legislative Budget Board determines that further action is
3939 necessary to prevent loss to the state from a contract for which a
4040 plan was not developed or implemented as described by Subsection
4141 (c)(1) or (2), the division shall:
4242 (1) provide written notice to the governor of the risk
4343 of loss to the state from the contract along with contract
4444 documentation; and
4545 (2) send a copy of the notice to the state agency that
4646 executed the contract.
4747 (e) The governor's office shall review the contract
4848 documentation and consult with the division before making a
4949 determination on whether to contact the governing body of the state
5050 agency or the single state officer who governs the state agency to
5151 work together to prevent loss to the state from the contract.
5252 (f) A state agency shall provide the division any
5353 information necessary for the division to perform the division's
5454 duties under this section.
5555 Sec. 2262.203. RULES. The Legislative Budget Board may
5656 adopt rules to implement this subchapter.
5757 SECTION 2. Subchapter E, Chapter 2262, Government Code, as
5858 added by this Act, applies only to a contract for which a state
5959 agency first advertises or otherwise solicits bids, proposals,
6060 offers, or qualifications on or after the effective date of this
6161 Act.
6262 SECTION 3. This Act takes effect September 1, 2015.
