55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to overtime pay for certain information technology state
88 employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 659.015(i), Government Code, is amended
1111 to read as follows:
1212 (i) With authorization from the administrative head of the
1313 agency for which an employee works, or that person's designee, an
1414 employee may be paid an amount based on the employee's regular rate
1515 of pay for:
1616 (1) the hours of compensatory time the employee earns
1717 for work directly related to a disaster or emergency declared by the
1818 appropriate officer of the state or federal government; or
1919 (2) all or part of the hours of compensatory time the
2020 employee earns for work in an information technology position
2121 requiring skills in high demand in the information technology labor
2222 market.
2323 SECTION 2. Section 659.016(i), Government Code, is amended
2424 to read as follows:
2525 (i) Except as provided by this subsection and Subsection
2626 (j), an employee covered by this section may not be paid for any
2727 unused compensatory time. With authorization from the
2828 administrative head of the agency for which a state employee works,
2929 or that person's designee, an employee may be paid an amount based
3030 on the employee's regular rate of pay for:
3131 (1) the hours of compensatory time the employee earns
3232 for work directly related to a disaster or emergency declared by the
3333 appropriate officer of the state or federal government; or
3434 (2) all or part of the hours of compensatory time the
3535 employee earns for work in an information technology position
3636 requiring skills in high demand in the information technology labor
3737 market.
3838 SECTION 3. The changes in law made by this Act apply only to
3939 compensatory time earned on or after the effective date of this Act.
4040 SECTION 4. This Act takes effect September 1, 2015.
