55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the consideration of ownership interests of certain
88 persons with disabilities in determining whether a business is a
99 historically underutilized business for purposes of state
1010 contracting.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2161.001(3), Government Code, is amended
1313 to read as follows:
1414 (3) "Economically disadvantaged person" means a
1515 person who:
1616 (A) is economically disadvantaged because of the
1717 person's identification as a member of a certain group, including:
1818 (i) Black Americans;
1919 (ii) Hispanic Americans;
2020 (iii) women;
2121 (iv) Asian Pacific Americans;
2222 (v) Native Americans; [and]
2323 (vi) veterans as defined by 38 U.S.C.
2424 Section 101(2) who have suffered at least a 20 percent
2525 service-connected disability as defined by 38 U.S.C. Section
2626 101(16); and
2727 (vii) persons with a disability as defined
2828 by 42 U.S.C. Section 12102; and
2929 (B) has suffered the effects of discriminatory
3030 practices or other similar insidious circumstances over which the
3131 person has no control.
3232 SECTION 2. Section 2161.002, Government Code, is amended by
3333 adding Subsection (e) to read as follows:
3434 (e) The comptroller shall adopt rules to provide goals for
3535 increasing the contract awards for the purchase of goods or
3636 services by the commission and other state agencies to businesses
3737 that qualify as historically underutilized businesses because the
3838 businesses are owned or owned, operated, and controlled, as
3939 applicable, wholly or partly by one or more persons with a
4040 disability as defined by 42 U.S.C. Section 12102. The goals
4141 established under this subsection are in addition to the goals
4242 established under Subsections (c) and (d), and the goals
4343 established under Subsections (c) and (d) may not be reduced as a
4444 result of the establishment of goals under this subsection.
4545 SECTION 3. Section 2161.061, Government Code, is amended by
4646 adding Subsection (f) to read as follows:
4747 (f) To be certified by the commission as a historically
4848 underutilized business, a business owned by one or more persons who
4949 qualify as economically disadvantaged solely based on being a
5050 person with a disability must submit to the commission an affidavit
5151 from the physician of each owner claiming a disability verifying
5252 that owner's disability.
5353 SECTION 4. Section 2161.125, Government Code, is amended to
5454 read as follows:
5555 Sec. 2161.125. CATEGORIZATION OF HISTORICALLY
5656 UNDERUTILIZED BUSINESSES. The comptroller, in cooperation with
5757 each state agency reporting under this subchapter, shall categorize
5858 each historically underutilized business included in a report under
5959 this subchapter by sex, race, and ethnicity and by whether the
6060 business qualifies as a historically underutilized business
6161 because it is owned or owned, operated, and controlled, as
6262 applicable, wholly or partly by one or more persons with a
6363 disability as defined by 42 U.S.C. Section 12102 or one or more
6464 veterans as defined by 38 U.S.C. Section 101(2) who have suffered at
6565 least a 20 percent service-connected disability as defined by 38
6666 U.S.C. Section 101(16).
6767 SECTION 5. This Act takes effect September 1, 2015.
