55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to production requirements for holders of winery permits;
88 establishing minimum annual production requirements for permit
99 holders.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 16, Alcoholic Beverage Code, is amended
1212 by adding Section 16.012 to read as follows:
1313 Sec. 16.012. PRODUCTION REQUIREMENTS. (a) The holder of a
1414 winery permit must produce, bottle, or blend at least 200 gallons of
1515 wine or fruit brandy annually beginning in the 12-month period
1616 preceding the third anniversary of the date the winery's original
1717 permit is issued.
1818 (a-1) Notwithstanding Subsection (a), the holder of a
1919 winery permit issued before September 1, 2015, must produce,
2020 bottle, or blend at least 200 gallons of wine or fruit brandy
2121 annually beginning in the 12-month period preceding September 1,
2222 2018. This subsection expires September 1, 2019.
2323 (b) The winery activities required by this section may be
2424 done through an agreement authorized by Section 16.05 or through an
2525 agreement with another winery in this state for a bottling brand
2626 under an Alcohol and Tobacco Tax and Trade Bureau Basic Permit trade
2727 name application.
2828 (c) Failure to comply with this section constitutes grounds
2929 to cancel or suspend a winery permit or deny an application for
3030 renewal of a winery permit.
3131 SECTION 2. This Act takes effect September 1, 2015.
