10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Chapter 16, Alcoholic Beverage Code, is amended |
---|
12 | 12 | | by adding Section 16.012 to read as follows: |

13 | 13 | | Sec. 16.012. PRODUCTION REQUIREMENTS. (a) The holder of a |
---|
14 | 14 | | winery permit must produce, bottle, or blend at least 200 gallons of |
---|
15 | 15 | | wine or fruit brandy annually beginning in the 12-month period |
---|
16 | 16 | | preceding the third anniversary of the date the winery's original |
---|
17 | 17 | | permit is issued. |
---|
18 | 18 | | (a-1) Notwithstanding Subsection (a), the holder of a |
---|
19 | 19 | | winery permit issued before September 1, 2015, must produce, |
---|
20 | 20 | | bottle, or blend at least 200 gallons of wine or fruit brandy |
---|
21 | 21 | | annually beginning in the 12-month period preceding September 1, |
---|
22 | 22 | | 2018. This subsection expires September 1, 2019. |
---|
23 | 23 | | (b) The winery activities required by this section may be |
---|
24 | 24 | | done through an agreement authorized by Section 16.05 or through an |
---|
25 | 25 | | agreement with another winery in this state for a bottling brand |
---|
26 | 26 | | under an Alcohol and Tobacco Tax and Trade Bureau Basic Permit trade |
---|
27 | 27 | | name application. |
---|
28 | 28 | | (c) Failure to comply with this section constitutes grounds |
---|
29 | 29 | | to cancel or suspend a winery permit or deny an application for |
---|
30 | 30 | | renewal of a winery permit. |
---|
31 | 31 | | SECTION 2. This Act takes effect September 1, 2015. |
