8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter B, Chapter 2269, Government Code, is | |
10 | 10 | amended by adding Section 2269.060 to read as follows: | |
11 | 11 | Sec. 2269.060. ACCEPTABILITY OF CONSTRUCTION MATERIALS. | |
12 | 12 | (a) The governing body of a governmental entity that considers a | |
13 | 13 | construction contract using a method authorized by this chapter may | |
14 | 14 | not unreasonably restrict or eliminate the consideration of | |
15 | 15 | construction materials used in the contracting and delivery of a | |
16 | 16 | construction project. | |
17 | 17 | (b) No construction documents or any other information | |
18 | 18 | associated with the preparation of a request for bids as prescribed | |
19 | 19 | by this chapter shall prohibit the consideration of construction | |
20 | 20 | materials, including piping materials, that meet current and | |
21 | 21 | recognized standards as issued by the American Society for Testing | |
22 | 22 | and Materials (ASTM) or the American Water Works Association or | |
23 | 23 | their successor organizations. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2015 |
