| 8 | 8 | | receipt of a statement from a family member that the person is |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 16.031(b), Election Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (b) The registrar shall cancel a voter's registration |
|---|
| 14 | 14 | | immediately if the registrar: |
|---|
| 15 | 15 | | (1) determines from information received under |
|---|
| 16 | 16 | | Section 16.001(c) that the voter is deceased; |
|---|
| 17 | 17 | | (2) has personal knowledge that the voter is deceased; |
|---|
| 18 | 18 | | (3) receives from a person related within the second |
|---|
| 19 | 19 | | degree by consanguinity or affinity, as determined under Chapter |
|---|
| 20 | 20 | | 573, Government Code, to the voter a signed [sworn] statement by |
|---|
| 21 | 21 | | that person indicating that the voter is deceased; or |
|---|
| 22 | 22 | | (4) receives notice from the secretary of state under |
|---|
| 23 | 23 | | Section 18.068 that the voter is deceased. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2015. |
