55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the cancellation of a person's voter registration on
88 receipt of a statement from a family member that the person is
99 deceased.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 16.031(b), Election Code, is amended to
1212 read as follows:
1313 (b) The registrar shall cancel a voter's registration
1414 immediately if the registrar:
1515 (1) determines from information received under
1616 Section 16.001(c) that the voter is deceased;
1717 (2) has personal knowledge that the voter is deceased;
1818 (3) receives from a person related within the second
1919 degree by consanguinity or affinity, as determined under Chapter
2020 573, Government Code, to the voter a signed [sworn] statement by
2121 that person indicating that the voter is deceased; or
2222 (4) receives notice from the secretary of state under
2323 Section 18.068 that the voter is deceased.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2015.
