88 AN ACT
99 relating to access to and review of a person's employment records
1010 held by a law enforcement agency.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 143.089, Local Government Code, is
1313 amended by amending Subsection (g) and adding Subsections (h) and
1414 (i) to read as follows:
1515 (g) A fire or police department may maintain a department
1616 [personnel] file on a fire fighter or police officer employed by the
1717 department for the department's use. Except as provided by
1818 Subsection (h), [but] the department may not release any
1919 information contained in the department file to any agency or
2020 person requesting information relating to a fire fighter or police
2121 officer. The department shall refer to the director or the
2222 director's designee a person or agency that requests information
2323 that is maintained in the fire fighter's or police officer's
2424 department [personnel] file.
2525 (h) A police officer is entitled to view the contents of the
2626 officer's department file maintained under Subsection (g) and is
2727 entitled, on request, to a copy of any document in the officer's
2828 department file.
2929 (i) A police department shall include in a police officer's
3030 department file maintained under Subsection (g) any statement that
3131 the officer requests to be included in the file.
3232 SECTION 2. Section 1701.451, Occupations Code, is amended
3333 by amending Subsections (a) and (a-1) and adding Subsections (d)
3434 and (e) to read as follows:
3535 (a) Before a law enforcement agency may hire a person
3636 licensed under this chapter, the agency head or the agency head's
3737 designee must:
3838 (1) make a request to the commission for any
3939 employment termination report regarding the person that is
4040 maintained by the commission under this subchapter; and
4141 (2) submit to the commission on the form prescribed by
4242 the commission confirmation that the agency:
4343 (A) conducted in the manner prescribed by the
4444 commission a criminal background check regarding the person;
4545 (B) obtained the person's written consent on a
4646 form prescribed by the commission for the agency to view the
4747 person's employment records;
4848 (C) obtained from the commission any service or
4949 education records regarding the person maintained by the
5050 commission; and
5151 (D) reviewed the person's employment records
5252 from [contacted] each of the person's previous law enforcement
5353 employers.
5454 (a-1) A law enforcement agency that obtains a consent form
5555 described by Subsection (a)(2)(B) shall make the person's
5656 employment records available to a hiring law enforcement agency on
5757 request. The commission by rule shall prescribe the manner by which
5858 a law enforcement agency shall make a person's employment records
5959 available to a hiring law enforcement agency.
6060 (d) A law enforcement agency's failure to review a person's
6161 employment records as required by Subsection (a)(2)(D) or to make a
6262 person's employment records available as required by Subsection
6363 (a-1) constitutes grounds for imposing an administrative penalty
6464 under Section 1701.507.
6565 (e) To the extent of any conflict between this section and
6666 Section 143.089, Local Government Code, this section controls.
6767 SECTION 3. The changes in law made by this Act to Section
6868 143.089, Local Government Code, apply to a request to view or obtain
6969 a copy of information made on or after the effective date of this
7070 Act. Section 143.089(h), Local Government Code, as added by this
7171 Act, applies to the entire contents of a department file regardless
7272 of the date on which a document or other information was placed in
7373 the department file.
7474 SECTION 4. (a) Not later than December 1, 2015, the Texas
7575 Commission on Law Enforcement shall adopt rules and update forms as
7676 necessary to comply with Section 1701.451, Occupations Code, as
7777 amended by this Act.
7878 (b) Section 1701.451, Occupations Code, as amended by this
7979 Act, applies only to the hiring of a person by a law enforcement
8080 agency that occurs on or after December 1, 2015. The hiring of a
8181 person by a law enforcement agency that occurs before that date is
8282 governed by the law in effect immediately before the effective date
8383 of this Act, and the former law is continued in effect for that
8484 purpose.
8585 SECTION 5. This Act takes effect September 1, 2015.
